Fall 2003 - The City received a court order to enter the home for an inspection to <br />determine if the structure was unsafe as defined in the building code. The conclusion of <br />the inspection determined that the structure is currently in violation of MN State Building <br />Code Section 1308.0180 “Unsafe Building”. The structure was declared unsafe and its <br />Certificate of Occupancy was revoked. The building was ordered to be repaired or <br />demolished within 90 days as communicated to the owner, Ms. Shu Lien Wu, in a letter <br />dated October 15, 2003. <br />2004 - The property continues to be in violation of city codes. Specific violations include <br />broken storm door, peeling paint, rodent holes in siding and roof, missing light fixture on <br />pole in yard, rusted rain gutters throughout and junk/debris in year yard. The City <br />continues to receive complaints from area residents regarding the property and its <br />negative affect on the neighborhood. The building has not been demolished or repaired <br />and remains in an unsafe condition. Roseville’s City attorney prepared a memo outlining <br />options available to the City in dealing with this property. The City Attorney’s <br />perspective is that the HRA has broader powers to acquire the site using its statutory <br />authority MN Stat. 469-012 which allows the HRA to use eminent domain to acquire <br />“substandard buildings or improvements”. <br />March 2004 – The HRA discussed the condition of the property and directed staff to <br />order an appraisal of the property for use in consideration of purchase under eminent <br />domain. <br />April 2004 – The HRA considered a resolution to set a public hearing for consideration <br />of use of eminent domain of 2012 Eldridge. Mr. Frank Wu - now legal owner of the <br />property – spoke to the HRA regarding his intention to build a new home on the site <br />beginning this year. The HRA delayed action on setting a public hearing to allow Mr. <br />Wu to prepare a schedule for demolition and construction of the new home within 30 <br />days. <br />May 2004 – Mr. Wu prepared a preliminary schedule for demolition and construction of <br />a new home. The HRA is concerned about the demolition schedule not occurring until <br />the fall of 2004 and therefore adopted a resolution setting a public hearing for June 15, <br />2004 to consider the use of eminent domain for the property. <br />\\Victoria\CommDev\Housing\Housing_Files_(HF)\HF0020_2012 Eldridge\HISTORY OF PROPERTY AT 2012 ELDRIDGE.doc <br />
