June 1996 <br />By July 1, 1996, the legislature will <br />establish a fund to reimburse 90 percent of <br />costs associated with disposal of contami- <br />nated used oil collected from Minnesota <br />DIYs. These DIY collection facilities <br />throughout Minnesota can apply to the <br />MPCA to recoup disposal costs for used <br />oil, which needs to be managed as hazard- <br />ouswaste due to contamination from <br />collection activities. <br />DIY collection facilities will. p-7Xbe exempt <br />from Minnesota Superfund liability for any <br />off-site management of their collected used <br />oil and/or used oil filters that have been <br />managed in accordance with Minn. Rules <br />Ch. 7045. <br />The industry group and the MPCA will <br />monitor the success of the DIY collection <br />program in Minnesota after the industry <br />plan is implemented in 1997, and the <br />MPCA will report on the success of the <br />state's program to the Minnesota Legisla- <br />ture by January 15, 1999. In the report, <br />the MPCA will recommend either continu- <br />ation ofthe industry DIY used oiI/filter <br />collection program, or implementation of a <br />mandated used oil/filter collection program <br />for retailers who sell over 1000 oil filters <br />per year. <br />IS7CS fu g echanis <br />available to nicipalities <br />Anew law signed on April 2 allows munici- <br />palities (townships, cities and counties, as <br />well ascertain other subdivisions) to fund <br />Individual Sewage Treatment System <br />(ISTS) upgrades and well replacements <br />through property tax assessments. <br />Local units of government can now create <br />a pool offends eitherthrough general <br />obligation bonds or by designating money <br />from other sources, which will then be <br />loaned to homeowners who need to <br />upgrade orrepiace existing ISTS and <br />private wells. ISTS maybe for single- <br />family systems or clusters, where appropri- <br />ate. An ISTS ordinance must be in place <br />within the local government's jurisdiction <br />for this program to be used. The new <br />provision focuses on existing systems and <br />cannot be used to finance new develop- <br />ment. <br />This law enables local governments to take <br />charge of problems by funding sanitary <br />improvements in ?*eas not addressed by <br />state programs. The program can be locally <br />tailored to meet specific local needs without <br />undue state oversight or involvement. <br />1~tctiv per i~ possible for large ant al fec lobs <br />The MPCA is proposing a new permit for <br />lazge animal feedlots operating in the state <br />of Minnesota. In June the MPCA will place <br />the draft General National Pollutant Dis- <br />charge Elimination System (NPDES) <br />Feedlot Permit on public notice. The permit <br />will be for existing and proposed feedlots <br />with 1000 or more animals. <br />The NPDES permit is a federal permitting <br />system used to control dischazges to surface_ <br />waters from a point source. In 197? <br />'`concentrated animal'feeding operations" <br />were included in the definition ofpoint <br />source pollution and were required to have <br />a NPDES permit. The ~IPCA has adminis- <br />teredthe NPDES process at the state level <br />since 1974: only since 1987 has Minnesota <br />been authorized to issue general NPDES <br />permits. <br />A general NPDES permit applies to facilities <br />that have the following factors in common: <br />they have same or similar operations; the <br />potential to discharge or dispose of the same <br />types of waste; or are subject to similar <br />standards, limitations, operating and moni- <br />toring requirements. <br />Recently the Environmental Protection <br />Agency provided guidelines regarding <br />applications for NPDES permits.
