Simonson: <br />As you may be aware, the legislature recently made changes to iViinnesota Statutes 103B.235 and <br />473.859. These changes relate primarily to the review of local storm water management plans, <br />by inserting the Metropolitan Council in the review process. In recent months, several cities <br />forgot to notify the Council ofhaving a storm waiei plan. These orni~~sions resulted in some <br />delays in getting approval of the plans by the appropriate watershed management organizations. <br />Minnesota Statutes 103B.235 requires watershed management organizations to prepare <br />watershed plans that address water quality issues. In turn, your community is required to prepare <br />a local water management plan, capital improvement program, and official controls necessary to <br />implement your watershed's plan. Local water management plans should be completed within <br />tivo years after the adoption of the watershed plan. If your community lies within more than one <br />watershed, you need not complete a local water management plan until the last applicable <br />watershed plan is adopted. <br />IVlinnesota Statute 103B.235, subd. 3 states that the Metro Area communities are to send a copy <br />of the local water management plan to the Metropolitan Council concurrently with submittal to <br />the watershed management organization. The Council then sends its comments to the watershed <br />management organization far incorporation into their final review and approval process. <br />The Metropolitan Land Planning Act, Minnesota Statutes 473.859 subd. 2 and 473.864 subd. 2 <br />was amended in 1995 to include the local water management plan as part of the land use <br />element of the local comprehensive plan.
