The Board of Water and Soil Resources (BWSR) intends to adopt rules <br />without a public hearing following the procedures set forth in the Administrative Procedure Act, <br />Minnesota Statutes, sections 14.22 to 14.28, and rules of the Office ofAdministrative Hearings, <br />IVlinnesota Rules, parts 1400.2300 to 1400.2310. If, however, 26 or more persons submit a <br />written reouest for a hearing nn the rules within 30 days or by 4:30 p.m. on February 1 1, 1998, a <br />public hearing will be held on February 26, 1998 from 7 p.m. to 10 p.m. in the Stearns County <br />Historical .Society Heritage Center, 235 So. 33rd Avenue (on Highway 1 ~ just north of Interstate <br />94), St. Cloud, MN 66302 (phone m: 320-253-8424). To find out whether the rules will be <br />adopted without a hearing or if the hearing will be held, you should contact the agency contact <br />person after February 11, 1998 and before February 26, 1998. <br />Agency Contact Person. The proposed rules are an amendment to <br />the Wetland Conservation Act (WCA) Rules. The BWSR is proposing a rule amendment that <br />will simply convert the ~Yisting ~rempt ("emergency') rtcles developed to incorporate the 1996 <br />legislative changes - acrd wlziclt ~rpire on .7ccne 10, 1998 -into permanent rules without any <br />change. i/linnesota Statutes sections 1038.101, Subd. 7, 1038.3366 and 103G.2242. Subd. 1 <br />authorize the BWSR to adopt rules related to replacement of wetlands.
