12. Fis~Qawning and movement No work affecting the bed of a watercourse maybe conducted between April 1 and June 30 of any <br />year in order to m;nim;~e impacts on spring fish spawning. Where the permittee demonstrates that project will min;m;~e impacts to <br />fish habitat and migration, the exclusion dates may be waived upon written approval from the Area Fisheries Manager (772-7950). <br />13. Habitat Enhancement. Permittee shall contact the Department of Natural Resources Area Fisheries and Wildlife Managers to <br />determine opportunities to enhance habitat prior to commencing any work authorized by this permit. <br />14. Channel Diversion and Access Roads No access roads or temporary channel diversions to aid in construction of any project are <br />allowed below the OHW of public waters unless specifically authorized in writing by DNR Waters. <br />15. Navigation maintained or improved. Permittee is responsible for maintaining existing navigation or improving navigation to meet <br />public needs for use of and access to public waters. <br />16. No water level controls. Permittee is responsible for maintaining existing water level control elevations. <br />17. No flowlin%radient change. No change in the existing flowlinelgradient shall occur unless specifically authorized in writing by DNR <br />Waters. <br />18. No flood stage/damage increase. For the replacement of existing structures, stage increases for the regional (100-year) flood may <br />be allowed up to that created by the existing structure provided there are no structures in the reach affected by the stage increase. <br />19. Constnuction Aids. No construction of temporary channel diversions or placement of fill below the OHW for temporary work pads, <br />bypass roads, or coffer dams to aid in construction of any authorized structure is allowed unless specifically approved in writing by <br />DNR Waters. Only clean non-erosive fill shall be used and all such material shall be removed upon project completion., <br />20. CofferDams. The use of coffer dams to aid in construction of any project is not allowed unless specifically authorized in writing by <br />DNR Waters. <br />21. IaGU Notification. The permittee shall contact the responsible local unit of government official if any grading or filling is to be done <br />above (landward) of the ordinary high water level. <br />22. Environmental Review. This permit is not valid until completion of environmental review if the bridge/culvert construction is part <br />of a road project that includes other features that require a mandatory Environmental Assessment Worksheet. The Environmental <br />Assessment Worksheet results may change the location or conditions of this permit. <br />23. Annual reportin eeting, The pemuttee shall report annually to the Regional Hydrologist, 1200 Warner Road, St. Paul, MN 55106- <br />6793, concerning work accomplished under this permit, and projects subject to this permit as may be anticipated in the coming year <br />or in subsequent years. The report shall be filed prior to January 15 of each year. The permittee shall meet to discuss the report with <br />DNR Waters prior to April 15 of each year. If emergency or unforseen projects arise that are not included in the annual report, the <br />permittee shall contact the Area Hydrologist at the earliest opportunity to provide details and discuss project design and applicable <br />performance standards. <br />24. Hydrologic/hvdraulic reports. A hydrologicJhydraulic data report shall be provided for each project by the permittce. This report, <br />along with one set of construction plans, must be submitted to the Regional Hydrologist at 15 working days prior to commencing <br />construction for written approval. <br />25. Photog~aphs/Survevs. Upon completion of the authorized work, the pernuttee shall submit representative photographs and any as-built <br />surveys, as appropriate, of the project area to DNR Waters (1200 Warner Road, St. Paul., MN 55106-6793). <br />26. ewatering,, Temporary dewatering for constniction, in excess of 10,000 gallons per day or one million gallons per year, is authorized <br />by this permit provided the following conditions are met:. <br />a. A plan for the dewatering shall be submitted to the Regional Hydrologist for written prior approval. <br />b. All necessary erosion and sediment control measures shall be taken to prevent transportation of sediment. <br />
