align T/Iinnesota's two main <br />wetland regulatory programs, <br />the Public Waters Permit <br />Pro and the Wetland <br />Co anon Act (WCA), <br />reducing duplication between <br />them. Specific provisions of <br />SF g3 include: <br />® It requires the DA1R to <br />define wetlands on the <br />Protected Waters <br />Inventory (PWI) listing <br />of Public Waters Wet- <br />lands as either Public <br />Waters or as Wetlands. <br />For Public Waters <br />Wetlands to be reclassi- <br />fied as Public Waters, <br />they must be either <br />lacustrine wetlands as <br />defined by Cowardin, <br />et. al, or assigned a <br />shoreland management <br />classification by the <br />DIvR Commissioner. <br />The DNR would file a <br />copy of the changes <br />with the county auditor <br />and the local govern- <br />ment unit, with the <br />reclassification effective <br />upon approval of the <br />local government unit. <br />® It provides for enforce- <br />ment consistency . <br />between the Public <br />Waters Permit Program <br />and the Wetland Con- <br />servation Act by giving <br />DNR conservation <br />officers authority to <br />issue Cease and Desist <br />Orders for activities <br />impacting Public Wa- <br />ters and for activities <br />conducted by contrac- <br />tors in WCA wetlands. <br />The DNR would still be <br />able to issue Restoration <br />Orders for activities on <br />Public Waters. <br />® Exempts people doing <br />WCA wetland delinea- <br />tion work from soil <br />science license require- <br />ments for two years. <br />The exemption allows <br />the BWSR, in coopera- <br />tion with the 1Vlinnesota <br />Association of Profes- <br />sional Soil Scientists and <br />the Wetland Delineators <br />Association, to evaluate <br />the benefits and costs of <br />a wetland delineators <br />certification program. <br />® Standardizes wetland <br />activity statute reporting <br />requirements for the <br />°uulic s~:'ate:s Permit <br />Program and the WCA. <br />The DIVR and BWSR have <br />agreed to the request made by <br />Senator Stevens to use the <br />legislative interim to examine <br />the other areas considered in the <br />initial drafts of the legislation to <br />determine if agreement can be <br />reached in the following areas: <br />® DI~tR use of the Federal <br />19>;7 Wetland Delinea- <br />tion Manual as a basis <br />for determining the <br />jurisdiction of the re- <br />maining Public Waters <br />Wetlands. <br />® D1VR use of a more <br />WCA-like process to <br />determine how to ad- <br />dress projects taking <br />3 <br />
