8. In all cases where the pernrlttee by performing the work authorized by this permit shall involve the taking, using, or damaging of any property rights or interests of any other <br />person or persons, or of any publicly owned lands ~ improvements there ~ interests therein, the permittee, before proceeding, shall obtain the written. consent of all persons, <br />agencies, a authorities concerned, and shall acquire all property, rights and interests needed for the work. <br />9. This permit is permissive only. No liability shall be imposed by the State of Minrresota or any of its officers, agents ~ employees, officially a personally, oa account of the <br />granting hereof or on account of any damage to any person a property resuking from any odor omission of the permlttee a any of its agents, employees, a contractors. This <br />permit shall not be construed as estopping or limiting nay legal claims ~ right of action of any person other than the state against the permittee, its agents, employees, or <br />contractors, fa' any damage ~ injury resulting from any such act or omission, a as estopping ~ limiting nay legal claim or right of action of the state against tbe permitter, <br />its agents, employees, or contractors for violation of or failure to comply with the permit a applicable provisions of law. <br />10. Any extension ofthe surface of public waters resulting from work authorized by this permit shall become protected waters and left open and unobstnrcted for use by tbe public. <br />11. No material excavated by authority of this permit nor material from any other source, except as specified herein, shall be placed on any potion of the bed of said waters which <br />lies below (as indicated above.) <br />12. Where the work authorized by this permit involves the draining, filling a' burning of wetlands not subject to DNR jurisdiction, the permittee shall nd initiate any work under <br />this permit until the pemtit#ce has obtained official approval from the responsible goveromeatal unit as required by the Mimresota Wetlands Conservation Act of 1491. <br />SPECIAL PROVI$ION5 <br />1. Erosion control measures shall be adequately designed for the site characteristics. They may include staked haybales, diversion <br />channels, sediment ponds, or sediment fences. They shall be installed in accordance with "Protecting Water Quality in Urban Areas - <br />Best Management Practices for Minnesota" MPCA, October 1989, prior to commencement and maintained. throughout the project. <br />All exposed soil shall be stabilized as soon as possible and no later than 72 hours after the completion of the project. Topsoil. should <br />be used to re-dress disturbed soil areas and indigenous plant species should be used to revegetate disturbed areas whenever possible. <br />2. Any work below the water level shall be encircled by a flotation sediment curtain to prevent sediment from being transported beyond <br />the construction site. This sediment curtain shall be constructed and maintained as illustrated on the enclosure entitled "6.6 Flotation <br />Silt Curtain." The barrier shall be removed upon completion of the work after the silt has settled. <br />3. Future maintenance excavation of this project shall not exceed the dimensions herein authorized. Prior to commencing any <br />maintenance excavation, permittee shall advise the Department of Natural Resources, in writing, of the volume of material to be <br />removed, the manner of removal, and the spoil disposal site(s) proposed. Maintenance excavation shall not be commenced until the <br />Permittee's receipt of the Department's approval. <br />4. Excavated materials must be deposited or stored in an upland area, in a manner where the materials will not be redeposited into the <br />protected water by reasonably expected high water or runoff. <br />5. The permittee shall monitor all disturbed areas for the presence of purple loosestrife and control the plant as described in the attached <br />pamphlet titled "Purple Loosestrife Alert".
