PE 'S RESPONSIBYLTI'IES: <br />(a) FiAW METER <br />The Pemrittee shall equip each installation for appropriating ar using water with a flow meter. unless another method of measuring the quantity of water <br />appropriated to within tea (10) percent of actna€ amount withdrawn is approved by the Division of Waters. <br />(b) REPORTS. <br />Monthly records of the amount of water appropriated ornsed shall be recorded and reported annually to the Direcinr of the Division of Waters, ofl orbefore <br />Febntary IS of the following year, upon forms supplied by the Division with the General Permit. Appropriations that extxed 15 million gallons must <br />submit a processing fee with the annual water use report fomo. Failare w report appropriations shall be considered a violation of this permit. <br />(c) TRANSFER OR ASSTGNMENT_ <br />Any transferor assignment of rights, or sale of property shall void any aathorizations for appropriation under this General Pemtit The new owner or <br />property rights holder must submit a new notice to the Area Hydrologist <br />4, CO ONIER'S ADT13OR1TY: <br />(a) The Commissioner may inspect any installation utilized for the appropriation or use of water. The Permittee shall grant access to the site at aIl reasonable <br />times and shall supply such information concerning such installation as the Commissioner may require. <br />(b) The Commissioner may, as helshe deems necessary, require the Permittee io install gages and/or observation wells to monitor the impact of the Permittee's <br />appropriation on the water resource and it:quire the Permittee ro pay necessary costs of installation and maintenance. <br />(c} The Commissioner may restrict, suspend, amend or cancel this permit or any project approvals in accordance with applicable laws and rules for any cause <br />for the protection of pnblic interests, or for violation of the provisions of this permit. <br />5. PiTISS IC lisECORD: <br />All data, facts, plans, maps, applications, anneal water use reports, and any additional information submitted as part of this permit, and this permit itself art; <br />part of the public record and are available for public inspection a[ the offices of the Division of Waters. The information contained therein may be used by <br />the Division as it deems necessary. The submission of false data, statements, reports, or any such additional information, at any time shall be deemed as just <br />grounds far revocation of this permit <br />6. WETLAND COP15E1~VATIOPl ACT: <br />Where the wow authorized by this permit involves the draining or filling of wetlands not subject to DNR jurisdiction, the Perrnittee shall not initiate any <br />appropriation underthis permit until the Permittee has obtained official approval from the responsible governmental unitas regairsd by the Minnesota Wetland <br />Conservation Act <br />7. COPISERVATYORI PLAN: <br />The Permittee shall implernettt adequate soli and water conservation measures in order to protect water quality and prevent erosion and sedimentation and <br />must comply with conservation plans and best management practices that may be required by the Pollution Control Agency, the local Soil and Water <br />Conservation District, Iocat Watershed Management Organization, or other local units of government <br />S. 1DI<.SCJHARGE E>!1OSION ANID SIi:DIlVEENTATFON COPITROL: <br />The Permittee shall ensue: that discharge points are adequately protected from erosion and scour. The discharge shall be dispersed over sand bags, plastic <br />sheeting, natural rock riptap, or other approved energy dissipation measures. Adequate sedimentation control measures are rtxluired for discharge water that <br />contains suspended solids. Sediment control devices can be bypassed when the discharge water appears clear. <br />4. DdSCDAI;GE AIUTDO~AT)EOAI AtVD DOWNSTREAM ACTS: <br />This permit is valid only in conjunction with all required discharge authorizations. The appropriation and discharge of water must not adversely affect the <br />receiving water or downstream land owners, unless appropriate permissions and/or easements have been obtained. <br />lo. LA1VD oWNE oR ACCESS AO n1TS: <br />This permit is valid only as tong as the Permittee owns, controls or has permission to access and use lands where water will be appropriated, conveyed, and <br />used (discharged). <br />11. O AL IR/1PACTS: <br />This permit may not be valid in areas or Iocations where trntrt streams, calcareous fens or other significant environmental resources may be adversely impacted. <br />In such arras or locations, a separate water appropriation app&cation and permit may be required. The Area Hydrologist must be contacted far permit <br />application requirements. <br />12, SIIRFACE WATER SOiTRCFS: <br />All pump intakes must be screened m prevent fish from being drawn into the system, if fish are present The Division of Waters may require the suspension <br />of appropriations during periods of low flows and low water levels in order to maintain m;nimnm Bows and water levels within the watershed. This permit <br />is not valid for appropriations firm surface water sources that are infested with exotic species (Minnesota Roles 6216.050. <br />13. ORDINARY ffitGH WA'TL+'R L1EV)EY.: <br />This permit does not authorize appropriations from public waters and pnblic waters wetlands when water levels are at or below the oniinary high water level <br />forthe basin as determined by the I?epartmestt A separate application and permit may be required from the Department to lower water levels below the ordinary <br />high wader revel of the basin. <br />14. ADDYTIONAL CONDITIONS: <br />The permittee most comply with additional conditions that may be required by the Area Hydrologist, oilier agencies or local governments to prevent adverse <br />affects caused by the approbation and discharge of water.
