PFRMT.SSinN TC NFRRRV r,R eN'I'Fn Tn• <br />PERMITTEE <br />Governmental Subdivisions and the General Public, located in the seven-county T/Ietropolitan Area <br />To Appropriate From: <br />Surface water basins of the state located in the seven-county Metropolitan Area (including those that are public <br />waters and public water wetlands), storm water ponds, and any flooded lands. <br />Purpose: <br />Temporary surface water appropriations to conduct stormwater basin maintenance work and to reduce <br />flooding conditions. The appropriation and discharge of water must not adversely affect the receiving water or <br />downstream land owners, and is only allowed on Public Waters and Public Water Wetlands when their <br />levels are above the (Jrdinary High Water (OHW) level of the affected basin. <br />Term of Permit: <br />This permit is valid from September 30, 2000 to September 30, 2005. However, each temporary appropriation <br />authorized under this permit must receive the approval of the Area Hydrologist, and such approval is not valid <br />for more than one year from date of approval. <br />Property Descrtbed as: <br />The Permittee must own, control, or have permission to access and use all lands where water is appropriated, <br />conveyed, and discharged. <br />Authorized Signature <br />~e Title ate <br /> S~p~ ~ 9, oZvod <br />Dale E. QUANTITY: <br />The total amount of water appropriated firm a single basin or area shall no[ exceed JrQ million gallons per year. A water appropriation pernvt application must <br />be submitted for projects that will exceed 50 million gallons yearly, or if the discharge exceeds an average of 2 million gallons per day in a 30-day period. <br />2. LIlI~TATI®NS: <br />(a) Any violation of the terms and provisions of this permit and any appropriation of the waters of the state in excess of that authorized hereon shall constitute <br />a violation of Minnesota Statutes, Chapter 103. <br />(b) This permit shall not be constmed as establishing any priority of appropriation of waters of the state. <br />(c) This permit is permissive only. No liability shall be imposed upon or incurred by the State of Minnesota or any of its employees, on account of the <br />granting hereof or on account of any damage to any person or property resulting firm any act or omission of the Permittee relating to any matter hereunder. <br />This permit shall not be construed as estopping or limiting any legal claims or right of action of any person other than the state against the Permittee, for <br />any damage or injury resulting from any such act or omission, or as estopping or limiting any legal claim or right of action of the state against the <br />Permittee, for violation of or failure to comply with the previsions of the penult or applicable provisions of law. <br />(d) in all cases where the doing by the Permittee of anything authorized by this permit shall involve the taking, using, or damaging of any property, rights <br />or interests of any other person or persons, or of any publicly owned lands or improvements thereon or interests therein, the Permittee, before proceeding <br />therewith, shall obtain the written consent of all persons, agencies, or authorities concerned, and shall acquire all property, rights, and interests necessary <br />therefore. <br />(e) This permit shall not release the Pennittee from any other permit requirements or liability or obligation imposed by Minnesota Statutes, Federal Law, or <br />local ordinances relating thereto and shall remain in force subject to all conditions and limitations now or hereafter imposed by law. <br />(f) Unless explicitly specified, this permit does not authorize any alterations of the beds or banks of any public (protected) waters or wetlands. A separate <br />permit must be obtained from the Department of Natural Resources prior to any such alteration. <br />g) The Area Hydrologist shall be notified at least five days in advance of coro..>Pnrn~. '+t of any project authorized hereunder and shall be notified <br />of its completion within five days thereafter. The authorization contained in this permit shall not be valid until receipt of approval of the Area Hydrologist. <br />Such approval must be requested on the notification form which is made an attachment to this permit Failure to submit such a form shall be considered <br />a violation of this permit <br />- OVER - <br />
