Sandusky <br />Director <br />Environmental Outcomes Division <br />SUBJECT: The Draft 2000 TMDL List <br />During the public comment period for the draft 2000 TMDL list, the Minnesota Pollution <br />Control Agency (Agency) received several letters recommending we re-consider our intent to <br />forward the TMDL list to the U.S. Environmental Protection Agency (EPA). We give all letters <br />we receive very serious consideration. <br />The Commissioner of the MPCA has made a preliminary decision to not send the draft 2000 <br />TMDL list to EPA as originally proposed. The Commissioner has also preliminarily decided that <br />the MPCA should engage in rulemaking with respect to the listing methodology used to <br />determine impaired waters status as a result of the application of narrative water quality <br />standards. The Agency is engaged in consultations with stakeholder groups regarding the scope <br />and schedule of these rulemaking activities before a final decision is made. <br />The Agency will begin the formal rulemaking process once the scope of the process has been <br />determined.
