BWSR Meeting Minutes <br />April 25, 2001 <br />Page- Two <br />Chair Coe called the meeting to order at 9:00 a.m. Chair Coe welcomed the new board <br />members. <br />Introductions were made of others in attendance: Sandy Hooker, Minnesota <br />Association of Townships, replacing Franklin Denn. Representatives of Rice Creek <br />Watershed District: George Lander, Loren Henscher, Michelle Ulrich, attorney, Harold .~ <br />- Sheff! and court reporter Marcia Everison. - -- _ _ __ <br />Adopt Agenda -Chair Coe added an additional item under New Business #3 -elect a <br />** vice-chair. Moved by Char Kahler, seconded by Jerome Deal, to approve the agenda <br />o~-2s as amended. Motion passed on a voice vote. <br />** Minutes of March 28, 2001 -Moved by Jack Frost, seconded by Jerome Deal, to <br />o~-2s approve the minutes of March 28, 2001 as circulated.. Motion passed on a voice vote. <br />Reports <br />Chair Coe reported that he attended the private forest management meeting in <br />McGregor, which addressed the needs for forestry stewardship in the private sector. He <br />attended the EQB meeting and, had EQB legislative information available for those <br />interested. <br />Executive Director -Ron Harnack stated that legislative, budget, and flooding issues <br />have been important items of concern. Ron reported that he received the Legislative <br />Audit Report; he will. meet with Chair Coe and the Vice-Chair elect to review the report, <br />and prepare a response. Ron stated that a confirmation hearing may be held this year <br />for the BWSR chair. <br />Dispute Resolution Committee -Chair Coe reported that in addition to the appeal on the <br />agenda today, there are presently three appeals pending. One pending appeal regards <br />a matter that was previously heard by the DRC. It involves a replacement plan approval <br />in Murray County that arose from a violation. The Murray SWCD previously approved a <br />replacement plan and this Board reversed that approval. Now, Murray SWCD has <br />approved another replacement plan and it has been appealed. At issue in this appeal <br />is sequencing and whether any feasible and prudent alternatives are available that <br />would avoid and minimize impacts to wetlands. The appeal has been accepted and a <br />pre-hearing conference will be set once the record has been received from the SWCD. <br />Another pending appeal regards an exemption approval by the Lac Qui Parle-Yellow <br />Bank Watershed District involving the federal exemption. The appeal has been <br />accepted and apse-hearing conference has not been set since resolution will be <br />pursued. <br />
