BWSR Meeting Minutes <br />October 25, 2001 <br />Page Three <br />pending. The most recent appeals are of two exemption determinations in the City of <br />Maple Lake. Both appeals are being remanded to the city for the city to develop a <br />better record that. includes a technical evaluation panel report and findings that support <br />their decision. There was a pending appeal involving a cease and desist order in the <br />City of East Bethel. The appeal was denied since cease and desist orders cannot be <br />appealed to BWSR. The applicant will probably follow the restoration order and apply <br />for an exemption or replacement plan. That decision could then be appealed. The rest <br />of the appeals have been reported to the Board previously. There is an appeal of a no- <br />loss decision in Mower County. The appeal was remanded since the decision was <br />made by a staff individual with no public hearing. The -Mower SWCD Board plans to <br />hear the matter in early November. Two other pending appeals involve the same <br />exemption determination by the Rice Creek Watershed- District.. The appeals have <br />been accepted and a prehearing conference will be scheduled once the record is <br />received. The hearing before the DRC will probably be in early January. Another <br />pending appeal is of an exemption determination in McLeod County. The appeal has <br />been remanded to the county to develop a better record including more technical <br />analysis. At a recent county board meeting, the county affirmed their previous decision. <br />Another pending appeal is in LaCrescent along the Mississippi River in Houston <br />County. The. replacement plan denial arose from a cease and desist order and a <br />restoration order. The appeal has been accepted and at the prehearing conference <br />resolution was. explored. The appeal is pending while discussions occur with the <br />landowner, the city, and the county. <br />Char Kahler asked about the DRC viewing appeal sites. Ron Harnack stated that <br />viewing a site can give you a better idea of seeing what's involved, which can be <br />beneficial in the dispute resolution process. Ron stated that Jim Haertel and John <br />Jaschke need to be involved in scheduling sites reviews with the parties involved. Ron <br />stated that it's not a good idea to view the site if the appeal has been remanded back, <br />but otherwise, to review the site is appropriate. <br />Agency Reports <br />Mark Dittrich, Department of Agriculture (MDA), reported that MDA is working with <br />MRCS on organic production. A survey was sent to organic producers asking how the <br />state can help... Mark commented on MDA's work and programs regarding apple <br />growing; plant pesticides, and soybean aphids. Mark distributed a directory of feedlot <br />resources and feedlot rules. <br />Dan Wilson, Department of Health (MDH), reported that the strike effects were handled <br />well by their division, they got through the strike pretty well. Dan reported that MDH has <br />a hotline set up for the public to call regarding questions relating to anthrax. Dan stated <br />that there is much public interest in anthrax, MDH is receiving hundreds of calls with <br />
