Permit 02-30; Len Musolf Distributing - Vadnais Heights <br />Motion: Jack Frost moved, Bob Johnson seconded, to approve Permit #02-30. Motion carried. <br />Permit 02-31; Tachen~Office Building -Little Canada <br />Roger Lake asked for clarification on the intent of Special Provision #1. Staff's position is that the proposed <br />riprap swales leading from the parking lot to the pond will not hold up over time. The special provision gives <br />the applicant the choice of piping the water away from the parking lot to a new overflow Swale, or constructing <br />a concrete Swale from the parking lot to the normal water level of the pond. <br />Jack Frost raised the issue of what guarantee the District has that this particular swale, as well as similar <br />structures throughout the District, will be maintained over time. Karl stated that if individual problem sites are <br />called to our attention, the District or the city can require the property owner to correct the problem, but he feels <br />it would be unrealistic for staff to monitor all existing structures. Jack suggested that the GIS database be used <br />to send reminders to property owners to clean out these structures in order to maintain their intended design. He <br />felt that the District and the cities should recognize this issue, and that it should be incorporated it into the next <br />Watershed Management Plan update. <br />Motion: Roger Lake moved, Bob Johnson seconded, to approve Permit #02-31. Motion carried. <br />Monthly Enforcement Report <br />During May, nine notices were issued to address the following violations on permit sites: repair silt fence (6), <br />sweep street (1), protect storm sewer inlets (1), vegetate site (4), excavate stormwater detention pond (2), <br />remove silt fence (1), and install overflow Swale on stormwater detention pond (1}. <br />WCA enforcement issues: <br />• Relative to the two properties located at the junction of Edgerton Road and Ripley Avenue in Maplewood: <br />Water levels have remained very high, preventing staff from making a determination as to how much <br />wetland fill actually occurred. This information is needed before the property owners can decide to either <br />remove the fill or replace it at a ratio of 4:1. <br />® Bailey Nursery still needs to remove fill from one small area of the wetland, and the slope next to the <br />wetland needs to be stabilized. <br />5. PROJECT STATUS REPORTS <br />CIP Maintenance/Repairs 2002 <br />Brad Lindaman reported that work is proceeding steadily, but is behind schedule. The substantial completion <br />date was May 15, and the final completion date is June 15. The Board considered Jay Bros' May 3lst letter, <br />requesting a time extension due to unusual precipitation. and also due to delays in receiving specific seed <br />mixtures that were required to be applied to certain sites immediately upon completion of the maintenance <br />work. If the Board agrees to the extension, Brad can add it to a pending change order that will be presented to <br />the Board at a subsequent meeting. <br />Motion: Roger Lake moved, Bob Johnson seconded, to authorize the final completion date to be extended to <br />June 28, 2002, for all sites with the exception of Sites 11 and 12, which will be extended until a date to be <br />determined in January 2003. Motion carried. <br />Follow-upon County Ditch 7A Sewer Problem <br />Board members received copies of Tracey Galowitz' 5/29/02 notice to Jimmy Richardson and the City of Little <br />Canada, stating that any and all defects within the construction limits of the original Watershed District project <br />have been properly corrected, and all future issues relating to maintenance or repair associated with County <br />Ditch 7A shall be the sole responsibility of either Mr. Richardson or the city. <br />Battle Creek Flood Protection Project <br />The bid tabulation from the May 28 bid opening was reviewed., which contained three bids and an engineer's <br />estimate of $78,385. Since Jay Bros. appears to be the low bidder, Brad asked that they respond to his concerns <br />about their ability to meet the District's requirements, considering they are behind schedule on the CIP <br />Maintenance/Repairs 2002 Project.
