RESOLUTION No.435 OF THE VILLAGE OF ROSEVIlLE liHEREAS, in the matter of the Application of the state of Minne- sota for judFment for delinquent real estate taxes in the County of Ramsey for the year 1956 of the Roselawn Cerrletery on account of assess- ments heretofore levied b/ the Village of Roseville for water main in- stallation, and, WHEREAS, the Minnesota Supreme Court has resolved in favor of the taxpayer, and, Ti'lHEREAS, pursuant to the Supreme Court decision, and Order has been signed b" one of the Judges of the District Court of Ramsey County order- ing the Ramsey County j\uditor, Treasurer and Clerk of the District Court to strike and delete from any and all pertinent record? the assessments insofar as they relate to tax years for which collection proceedings have not yet commenced, and that any pro ceedings ~vhich have commenced pursuant to statutory authority relating to the collection of any of the installments, are dismissed, and, \vHEREAS, William B. Ra.ndc>ll, County Attorney, and Gerald E. Rutman, Assistant County Attorney, are withholding the filing of the Order of the Co:'rt until a Rescblution is adopted, approving the filinp: of same, NOW, UfEREFDRE, BE IT RESOLVED by' the Village of Roseville, that said Orier of the District Court of Ramsey County, Minnesota., striking and de- leting the records, and dismissing the proceedings, be filed in accordance ~th the Order to accomplish the purposes therein set forth, and that \{illiam T3. Randall, County Attorney, be requested to file same with the Clerk of District Court of Ramsey County, the Ramsey County Auditor and the Ramsey County Treasurer. Mr. Reinecke moved and Mr. Shiells seconded that said Resolution be adopted and that a copy thereof be mailed to T,{illiam B. Randall, County Attorney. Vote upon motion for adoption of Resolution.
