Permit 02-58; Trunk Highway 61 Culvert Replacement -White Bear Lake <br />Pursuant to last month's Project Status Report regarding Willow Creek/County Ditch 18, MnDOT has applied <br />for a permit to complete the culvert replacement project under Highway 61 near the Buerkle Honda dealership. <br />Motion: Jack Frost moved, Paul Ellefson seconded, to approve Permit #02-58. Motion carried. <br />Permit 02-59; Rosewood Ponds -Oakdale <br />DNR has waived WCA jurisdiction over unnamed wetland 82-423W, which the District has categorized as a <br />Utilize wetland to be used to treat stormwater from this project. <br />Motion: Bob Johnson moved, Jack Frost seconded, to approve Permit #02-59. Motion carried. <br />Monthly Enforcement Report <br />No violation notices were issued during November. Most sites inspected were in order, or they were in need <br />of minor repairs that were discussed with the foremen onsite. <br />Ongoing enforcement issues involve staff's focus on the party responsible for damage to the wetland at Tartan <br />High School site (Permit #02-09). Tracey Galowitz has informed the school district superintendent of the <br />situation in the event that they are not aware of their contractor's failure to comply with the terms of the <br />Wetland Conservation Act on this site. <br />5. PROJECT STATUS REPORTS <br />CIP Maintenance/Repairs 2002 Project <br />Tracey reported on the letter that was sent to Jay Bros, detailing the deadline for specific work yet to be <br />completed, and informing them of the District's right to assess liquidated damages in accordance with the <br />terms of the contract if they fail to comply. <br />Owasso Basin Low Flow Pipeline Cleanout (Site 1): Brad Lindaman discussed the access problem which has <br />delayed the contractor's start. Staff expected to obtain permission from the City of St. Paul to use the same <br />access point they were allowed to use ten years ago; however, the city now requires the District to design and <br />construct a concrete pad over the top of the city's pipeline in order to spread out the load of the backhoe that <br />will be situated on top of the pipeline. In order to avoid a change order for these unanticipated costs, staff is <br />seeking an alternate access through the Slumberland parking lot, and Cliff believes it is reasonable for the <br />District to provide written assurance to the owner that the District will pay for any damages to the parking lot <br />that may result. <br />Battle Creek Tirnnellnspection (Site 12): Brad reported that the contractor is scheduled to mobilize and begin <br />dewatering operations on December 9 so that the pipe inspection can commence the next day. <br />CIP Maintenance/Repairs 2003 Project <br />Plan sheets and the cost estimate were distributed by Brad. All project sites were discussed in detail last <br />month, although total project costs have increased by about $15,000. Most of the increase relates to the <br />control structure in the channel for Site 4 (Lake Phalen/Keller Dam/Footbridge). Staff requested authorization <br />to advertise the project for bids. <br />Motion: Jack Frost moved, Paul Ellefson seconded, to authorize staff to finalize the bidding documents and <br />advertise for bids the CIP Maintenance/Repairs 2003 Project. Motion carried. <br />Project 3 -West Tamarack Swamp Improvements <br />Battle Creek Lake Flood Protection Project: Tracey reported that phone calls and another letter have been <br />sent to Jay Bros. on this project, detailing the deadline for specific work yet to be completed, and informing <br />them of the District's right to assess liquidated damages in accordance with the terms of the contract if they <br />fail to comply. Brad reported that no punch list items have been addressed, and Tracey has received no <br />response. <br />Protect 2 -Battle Creek Lake Area Water Management Project (ABI site) <br />Brad reported that although the contractor's final pay application has been processed this month, the contractor <br />would like to attend the next meeting to discuss their $1400 claim for additional compensation, which was <br />initially denied in April of this year by Barr Engineering staff.
