WHEREAS, the Vadnais Lake Area Water Management Organization at the request of the County, <br />convened a series of meetings of potential project partners beginning in April 2003 to evaluate the need and <br />impact of restoring the historic West Vadnais Lake outlet flow path to Lake Gervais; and <br />WHEREAS, the project partners determined that a new West Vadnais Lake outlet is needed to <br />provide a stable, low flow outlet for water derived from GLWMO and the Vadnais Lake Area Water <br />Management Organization and flowing into the District, and to protect the interests of the County and <br />Board with regard to high water levels on West Vadnais Lake; and <br />WHEREAS, the District has determined that water flow from the new West Vadnais Lake outlet <br />pipe will not increase 100-year return frequency high water elevations for Lake Gervais or other water <br />bodies downstream of West Vadnais Lake; and <br />WHEREAS, the District desires control of the West Vadnais Lake outlet pipe to regulate the <br />seasonal period of water flow directed to Lake Gervais; and <br />WHEREAS, the Minnesota Department of Transportation (MnDOT) plans to reconstruct I-694 east <br />of Rice St, beginning in 2005, which provides a unique opportunity for construction of a new outlet for <br />West Vadnais Lake under I-694; and <br />WHEREAS, MnDOT has developed construction plans for the I-694 project which incorporate <br />construction plans for an outlet from West Vadnais Lake at an elevation of 881.9 (1988 datum); and <br />WHEREAS, the estimated 95% construction cost for the West Vadnais outlet is $99,666; and <br />WHEREAS, the County and Board receive the primary benefit of the proposed West Vadnais Lake <br />outlet, with lesser, but significant, benefit to GLWMO and the Vadnais Lake Area Water Management <br />Organization; and <br />WHEREAS, the MnDOT Road Turn Back Program has agreed to pay 50% of the total construction <br />cost of the proposed West Vadnais Lake outlet on the basis of alleviating Rice Street flooding potential, <br />and to account for MnDOT funding participation in the West Vadnais Lake outlet project in determining <br />eligible costs to the County in the future State/ County turn back agreement for Rice Street; and <br />WHEREAS, the Vadnais Lake Area Water Management Organization is not willing to contribute to <br />the West Vadnais Lake outlet project if the County meets its project cost share obligation solely through the <br />application of MnDOT Road Turn Back Program funds for Rice Street, as proposed, and is therefore not <br />included as a project partner; and <br />WHEREAS, future land use or environmental changes may significantly impact the intended <br />function of the proposed West Vadnais Lake outlet pipe; and <br />WHEREAS, the County will be party with MnDOT to the I-694 reconstruction project agreement <br />for that portion of the project dealing with the West Vadnais Lake outlet; and <br />PW2004- ~(n 2 of 7 <br />
