While not having impetus to act tonight, Mayor Klausing <br />opined that he sees no reason for delay, and questioned the legality of making <br />land use decisions based on their tax exempt status or adoption of a policy to <br />force institutions to pay PILOT, based on court cases, when their tax status is <br />based on their provision of other benefits to the community. Mayor Klausing <br />further opined that this action, illustrated by the land use application from T4C, <br />provided proof that sometimes something was missed, and this was a good way to <br />rectify that omission. <br />Councilmember Johnson spoke in support of the text amendment, opining that it <br />was well thought-out and meets the intent; and expressed concern that another sit- <br />uation could come before the City Council in the near future, and have similar re- <br />percussions, as well as further wasting staff and Planning Commissioner time. <br />Councilmember Johnson further .opined that the open house, public hearing and <br />other discussions over the last few months provided sufficient advertisement of <br />the issue, and that staff had sufficiently noticed opportunities for public comment <br />as directed by the City Council. <br />Councilmember Pust spoke in support of the text amendment, after previous as- <br />surances from staff that the zoning code rewrite would further define use distinc- <br />tions. <br />• Klausing moved, Johnson seconded, adoption of Resolution No. 10810 entitled, <br />"A Resolution Amending the Text of Roseville's 2030 Comprehensive Plan to In- <br />clude Institutional Land Uses in Areas Guided for Regional Business, Community <br />Business, and Neighborhood Business Uses;" as addressed in Attachment A. <br />Councilmember Ihlan spoke in opposition to the motion, based on her previous <br />comments, and the lack of urgency to make a decision tonight without additional <br />public comment. <br />Roll Call <br />Ayes: Pust; Roe; Johnson; and Klausing. <br />Nays: Ihlan. <br />Motion carried with Super Majority. <br />d.
