<br />EXTRI\.CT OF MINUTES OF i'1EETING OF THE VILLAGE COUNCIL <br />OF ROSEVILLL, mNNESOTA - HELD FEBRUARY :i, 1970 <br /> <br />* * * * * * * * * * * * * * * * * * <br /> <br />Pursuant to due call and notice thereof, a regular meeting <br />of the Vi !lage Council of Rosevi lle, r'1innesota, was duly called <br />and held at the Vi Ilage Hall in said Vi llar,e on February 9, l:J70 <br />at 7: 30 P. M. <br /> <br />The following members were present: Mayor :',1011, Counci lmen <br />Curley, Grauel, Linebarger and Anderson <br /> <br />and the following were absent: i'Jone <br /> <br />~Iember Grauel introduced the following resolution and moved <br />its adoption: <br /> <br />RESOLUTIOI~ NO. 5313 <br /> <br />\vt!cREAS, the Village of Roseville has entered into an <br />Agreement authori zing the interconnection of pub lic sewers, and <br /> <br />\'JHEREAS, the City of St. Paul has interpreted Section 5, <br />paragraph 9, of said Agreement to provide that the suburb share <br />the cost of extraordinary repairs of all jointly-used se\Vers in <br />the proportion which the current rate of sewage discnar,!!ed by the <br />suburb in the repaired segment bears to the total rate of sanitary <br />sewage flO\" in the sewer segment, and <br /> <br />WHEREAS, no distinction is made in this interpretation between <br />sani tary sewers and combined sewers nor between rented sewers and those <br />in which a permanent capacity is beinl"1' acquired, and <br /> <br />WHEREAS, such an interpretation results in the suburbs cost <br />apportionment for extraordinary repair on a combined sewer to be <br />proportionately greater than the capacity utilized by the Suburb, <br /> <br />HE IT THEREFORE RESOLVED by the Village Council of the Village <br />of Roseville, Minnesota, that the Village objects to this recent <br />interpretation of Section 5, paragraph 9 of said Agreement by the City <br />of St. Paul and that the Village considers the sharing of extra- <br />ordinary repair costs of jointly-used sewers equitable only \"hen <br />apportioned on the basis of the percentape of conduit capacity <br />utilized or appropriated, and that the Villap.e hereby requests <br />clarification of the Agreement by deleting Section 5, paragraph 9 <br />and inserting in lieu thereof the followin?": <br />
