1. Elected clerks/Standard plan cities <br />Minn. slat. §§ 412.151, The elected city clerk position only exists In standard plan cities. <br />412.02, subd. 1 <br />although it can also exist in a home rule charter city if the city <br />charter so provides (charter cities should see their charters for <br />details). This section deals only with clerks of standard plan cities. <br />The city clerk position is required in ~~ standard plan statutory city. <br />The term of the elected clerk's office is four years. In the standard <br />plan city the clerk is also a member o_. the city council. The duties of <br />the clerk are discussed in a later section. <br />Minn. stac. § au2.o2, When a vacancy occurs Iri the elected clerk's office, it is filled by <br />subd. 2a. See Part III-C-I - <br />a orcb;s document. council appointment in the same manner as any other council <br />vacancy. This process is discussed in detail in a later section of this <br />memo. <br />Because this is an elected office, the clerk must be a resident of the <br />city in order to qualify for the office. 't'his requirement also holds <br />true for persons who are appointed to this office to fill a vacancy. <br />2. Appointed clerks <br />Minn. slat. § 412591 The city clerk office exists iri Plan A cities and some Plan B cities, <br />but is an appointed rather than elected office. It is often combined <br />with other positions to create positions such as the clerk-treasurer or <br />clerk-administrator positions. Since these positions are filled by the <br />council hiring an individual to serve in the role of clerk, the clerk's <br />term is indefinite. In short, the clerk may be removed by the council <br />or kept on for many years. <br />Minn. Stet. § 412.681 State statute provides that the Plan B city clerk position may also <br />exist at the same time as the city manager position. <br />Minn. slat. § 415.16 The appointed city clerk need not be a resident of the city because <br />the position is not an elected office. Further, state statutes prohibit a <br />city from requiring that the city clerk live within the city limits. <br />3. Home rule charter cities <br />The city clerk in a home rule charter city may be appointed or <br />elected, depending upon the city's charter provisions.
