appointed for an indefinite period of time and need not be a resident <br />of the city in order to hold the position. <br />2. Removal <br />Mann. slat. § a12.6a1 The city manager may be removed by the council at any time. <br />However, if the manager has served for one year or longer, the <br />manager may demand written chazges and a public hearing on the <br />charges before the final removal takes effect. The demand for written <br />charges must be made within seven days of notification of the <br />council's intent to remove the manager. <br />Minn. stet. § 412.641 The council must set a date and a reasonable time for a public <br />hearing. The hearing must be held within 30 days of the manager's <br />demand and the hearing may not be recessed or reconvened until a <br />further date unless approved by the council. <br />Minn. scat. § 412.641 Pending the hearing, the council may suspend the manager, with or <br />without pay. The council may designate another qualified person to <br />perform the duties of the manager during absence or disability. <br />Minn. slat. § 412.641 The council must notify the city manager within five days of the <br />hearing of their decision to retain or remove the manager. <br />City councils that are considering removal of their manager should <br />consult with their city attorney before beginning the removal <br />process. The council should also consider any relevant employment <br />contract language, personnel policies, and oruinance or charter <br />provisions. <br />Part VI. Common issues <br />There are a number of azeas that raise questions for city councils <br />regarding city clerks, administrators, and managers. These include <br />the following: <br />• Shared clerks or administrators. Although rather rare in <br />Minnesota, sometimes a group of smaller cities will share an <br />administrator or clerk. <br />• Qualifications. What should the council look for in a good <br />candidate to fill a vacant clerk, administrator, or manager <br />position? <br />• Pros and cons of employment contracts. Should the city use <br />an employment contract for its administrative office? <br />• Delegation of duties.
