EXTRACT OF MINUTES OF MEETING OF THE VARIANCE BOARD OF THE CITY OF ROSEVILLE Pursuant to due call and notice thereof, a regular meeting of the Variance Board of the City of Roseville, County of Ramsey, Minnesota, was held on the 4th day of May, 2005, at 5:00 p.m. The following members were present: Chair Bakeman and Members Pust, Doherty, and Boerigter Variance Board Member Boerigter introduced the following resolution and moved its adoption: VB RESOLUTION N0.15 A RESOLUTION APPROVING VARIANCES TO SECTION 1005 OF THE OF THE ROSEVILLE CITY CODE FOR DANIEL SMITH AND DAIRY QUEEN, 3070 LEXINGTON AVENUE (PF3639) WHEREAS, Daniel Smith has requested a VARIANCE to Section 1005.01 (Business District Dimensional Requirements) of the Roseville City Code to allow the relocation of an existing pylon sign on the premises; and WHEREAS, these property is addressed as 3070 Lexington Avenue, and legally described as: SEE EXHIBIT "A" PIN 03-29-23-22-0001 WHEREAS, Section 1005.01 (Business District Dimensional Requirements requires structures to be set back a minimum of 30 feet from a front yard property line; and WHEREAS, a pylon sign is determined to be a structure that requires a 30 foot setback form a front property line; and WHEREAS, Daniel Smith seeks to relocate his existing pylon sign from approximately 30 feet from the front yard property line to a distance of 1 foot; and WHEREAS, the City Planner has concluded that "hardships" are present and support can be given to deviate from the strict requirements of the Roseville City Code; NOW THEREFORE BE IT RESOLVED, by the Roseville Variance Board, to approve a 29 foot VARIANCE_to Section 1005.01 (Business District -Minimal Dimensional Requirements -Front Yard Setback) allowing the relocation of an existing pylon sign on the premises, subject to the following conditions:
