WHEREAS, the Lehr home was constructed in 1966 and lies 65 feet from the ordinary <br />high watermark of Lake Owasso, which location is non-conforming to the City Code. The <br />proposed kitchen addition will be no closer to the ordinary high water mark than the current <br />structure (a distance of 65 feet), and <br />WHEREAS, the proposed kitchen addition requires a VARIANCE of 10 feet in <br />accordance with Section 1013 of the Roseville City Code; and <br />WHEREAS, the City Planner has concluded that "hardships" are present and support can <br />be given to deviate from the strict requirements of the Roseville City Code; <br />NOW 'T'HEREFORE BE IT RESOL,VEI), by the Roseville Variance Board, to approve <br />a 10 foot VARIANCE to Section 1016.16A of the Roseville City Code for John Lehr, 3135 <br />Sandy Hook Drive to allow fora 9 foot by 12 foot kitchen expansion, subject to the following <br />conditions: <br />1. The kitchen addition must be set back a minimum of 65 feet from the OHW. The <br />addition must be an extension of the existing building footprint that does not <br />increase the non-conformity, but rather is a westerly expansion along the same <br />building line as the existing principal structure. New exterior materials are to <br />match the existing exterior materials in color and \or texture. <br />2. A scaled and dimensioned site plan indicating all existing conditions and the <br />proposed improvement must be submitted with the building permit application. <br />3. The variance will expire within six months after the approval date unless that <br />applicant has been granted a building permit. <br />The motion for the adoption of the foregoing resolution was duly seconded by Variance <br />Board Member Doherty and upon vote being taken thereon, the following voted in favor: <br />Traynor, Doherty, and Bakeman <br />and the following voted against: None <br />WHEREUPON said resolution was declared duly passed and adopted. <br />2 <br />
