EXTRACT OF MINUTES OF MEETING OF THE VARIANCE BOA OF THE CITE' OF ROSEVILLE Pursuant to due call and notice thereof, a regular meeting of the Variance Board of the City of Roseville, County of Ramsey, Minnesota, was held on the 3`d day of August, 2005 at 5:00 p.m. The following members were present: Chair Bakeman and Members Traynor and Doherty. Variance Board Member Traynor introduced the following resolution and moved its adoption: VB RESOLUTION N0.22 A RESOLUTION APPROVING A REQUEST BY KURTIS VIGGERS, 586 HEINEL DRIVE, FOR A VARIANCE TO SECTION 1012.02B3 (REQUIRED YARDS & OPEN SPACE - FENCES IN SIDE OR REAR YARD) OF THE ROSEVILLE CITY CODE (PF3652). WHEREAS, Kurt Viggers seeks approval of a 1-1/2 foot fence height VARIANCE to Section 1012.02B3 of the Roseville City Code to allow the installation of up to an 8 foot tall privacy fence in his rear (southeast) yard, and WHEREAS, the Viggers property is located at 586 Heinel Drive, and legally described as: LOT 3, BLOCK 2, DEZIEL AND ZINIEL ADDITION PIN: 01-29-23-23-0014 WHEREAS, Section 1012.02B3 (Residential Fence Regulations) of the Roseville City Code requires all rear yard fences to be no more than 6.5 feet in height above grade, and WHEREAS, the Viggers proposal would create an 8 foot fence height in the rear yard, , creating the need fora 2 foot variance, and WHEREAS, the proposed fence requires a VARIANCE of 2 feet in accordance with Section 1013 of the Roseville City Code; and WHEREAS, the City Planner has concluded that "hardships" are present and support can be given to deviate from the strict requirements of the Roseville City Code; NOW THEREI+'ORE BE IT RESOLVED, by the Roseville Variance Board, to approve a 2 foot VARIANCE to Section 1012.02B3 of the Roseville City Code for Kurt Viggers to allow the construction of an 8 foot fence height I the rear yard at 586 Heinel Drive, subject to the following condition:
