EXTRACT OF MINUTES OF MEETING OF THE VARIANCE BOARD OF THE CITY OF ROSEVILLE Pursuant to due call and notice thereof, a regular meeting of the Variance Board of the City of Roseville, County of Ramsey, Minnesota, was held on the 1St day of June, 2005, at 6:00 p.m. The following members were present: Chair Bakeman and Members Pust and Boerigter. Variance Board Member Bakeman introduced the following resolution and moved its adoption: VB RESOLUTION NO. 17 A RESOLUTION APPROVING A 2 FOOT FRONT SIDE AND A 4 FOOT FRONT VARIANCE TO SECTION 1012.02B2 (REQUIRED YARD & OPEN SPACE -SIDE OR REAR YARD ONLY) OF THE ROSEVILLE CITY CODE FOR JEAN AND NASIM AYUB, 936 HIGHWAY (PF3G43) WHEREAS, Jean and Nasim Ayub, 936 Highway 36, have requested a VARIANCE to Section 1012.02B2 (Required Yard & Open Space -Front Side and Front Yard Fence Height) of the Roseville City Code to allow the installation of a 6 foot fence along the front side lot lines and an 8 foot front yard privacy fence in the front yard adjacent to Highway 36; and WHEREAS, the Jean and Nasim Ayub property is located at 936 Highway 36, and legally described as: Lot 2, Block 1 Hamm-Hesli Addition, excluding the South 161 feet, and subject to sewer easement PID ll-29-23-34-0007 WHEREAS, 1012.02B2 requires fences in front and side yard fence height to be a maximum of 4 feet in height; and WHEREAS, Jean and Nasim Ayub, 936 Highway 36 desire to install a fence along their northern property line 8 feet in height and along their front side yards to a height of 6 feet; and WHEREAS, the City Planner has concluded that "hardships" are present and support can be given to deviate from the strict requirements of the Roseville City Code; NOW THEREFORE BE IT RESOLVED, by the Roseville Variance Board, to approve a Fence Height VARIANCE to Section 1012.02B2 of the Roseville City Code for Jean and Nasim Ayub, 936 Highway 36 to allow the installation of a 6 foot fence along the front side lot lines and an 8 foot front yard privacy fence along the north property line in the front yard adjacent to Highway 36 at 936 Highway 36, subject to the following conditions: 1. The fence must not exceeding a height of 8 feet measured from the existing grade to top of fence along the north side (front) of the property and 6 feet along the east (front side lot line) and west (front side lot line) of the front yard..
