WHEREAS, there is no definition of "essential services". However, the common zoning <br />definition refers to permitted common utility services, necessary for daily urban operations, that <br />are provided or available throughout the community to all property owners such as electricity, <br />gas, sewer, water, telephone, etc; and <br />WHEREAS, buildings for essential services require a conditional use permit in <br />residential districts but are not mentioned in industrial districts, where "public services' are <br />considered a permitted use; and <br />WHEREAS, staff concluded that while the proposed emergency power generator <br />provides a "back up" or reserve service, it was not essential to the public and did not serve more <br />than one property or site and therefore was not considered an essential service which would be <br />exempt from the setback provisions of the Code; and <br />WHEREAS, the City Planning Staff has concluded that "hardships" are present and <br />support can be given to deviate from the strict requirements of the Roseville City Code; <br />NOW THEREFORE BE IT RESOLVED, by the Roseville Variance Board, to approve a <br />19-foot front yard setback VARIANCE to § 1007.01 (Minimum Industrial Area & Building <br />Dimensional Requirements) of the Roseville City Code to allow the installation of an emergency <br />generator 21 feet from the front property line, subject to the following conditions: <br />1. The generator will be limited to a setback of 21 feet from the property line (a 19- <br />foot variance). <br />2. The generator must be screened with conifers, which are preserved on the site or <br />replaced on the site after the installation of the equipment. <br />3. The generator housing must be of (or be painted) a color which matches the <br />building facade. <br />4. The generator must meet Minnesota Pollution Control Agency noise standards for <br />exterior commercial\office environments. <br />5. The ground area around the base must include landscaping; low growing shrubs <br />and\or perennials is recommended. <br />6. The variance will expire within 6 months of its approval if a building permit is not <br />issued, pursuant to § 1013.03. <br />The motion for the adoption of the foregoing resolution was duly seconded by Variance <br />Board Member Boerigter and upon vote being taken thereon, the following voted in favor: <br />Members Bakeman, Boerigter, and Doherty <br />and none voted against; <br />WHEREUPON said resolution was declared duly passed and adopted. <br />2 <br />
