EX CT O TJ'I'S OF EE'I'l~G OFT E <br />VAR I®TCE BOA OE T E CITY OF ROSE I.E <br />Pursuant to due call and notice thereof, a regular meeting of the Variance Board of the City of <br />Roseville, County of Ramsey, Minnesota, was held on the 4th day of October, 2006, at 5:00 p.m. <br />The following members were present: Chair Bakeman and Members Boerigter and <br />Doherty. <br />Variance Board Member Bakeman introduced the following resolution and moved its adoption: <br />V~ RESOI,iJTIOI~T loTO.46 <br />A RESOLUTION APPROVING A 22 FOOT VARIANCE TO §1007.01 (MINIMUM <br />INDUSTRIAL A & BUILDING DIMENSIONAL REQUIREMENTS -FRONT <br />Y PA NG LOT SETBACK) OF TIIE ROSEVILLE CITY CODE FOR <br />CUNNINGS MOBILITY, 1755 COUNTY ROAD C (PF3767) <br />WHEREAS, Cummings Mobility has requested a VARIANCE to § 1007 (Industrial <br />Districts) to allow a parking area encroachment into the required front yard setback; and <br />WHEREAS, this property is addressed as 1755 County Road C, and legally described as: <br />TIIE W 500 FT. OF TIIE E 2,075 FT. OF TIIE SE QUARTER OF SECTION 4 <br />TOWNSIIIP 29 N, GE 23 W, EXCEPT TIIE N 1,737 FT. TIIEREOF AND EXCEPT <br />T T PART LYING S OF TIIE CENTERLINE OF COUNTY ROAD C <br />PIN: 04-29-23-43-0006 <br />WHEREAS, Section 1007.01 requires a minimum 40-foot setback for parking areas from <br />the right-of--way adjacent to the front property line; and <br />WHEREAS, Cummings Mobility seeks to continue using the existing parking area <br />which, as a result of the 2006 reconstruction of County Road C, is now within the required front <br />yard parking area setback; and <br />WHEREAS, the Planning Division has concluded that "hardships" are present and <br />support can be given to deviate from the strict requirements of the Roseville City Code if the <br />conditions identified below are met; <br />NOW THEREFORE BE IT RESOLVED, by the Roseville Variance Board, to approve a <br />22-foot VARIANCE to Section 1007.01 (Minimum Dimensional Requirements -Front Yard <br />Parking Setback) to allow the continued use of the existing parking area, which encroaches into <br />the required front yard parking setback at 1755 County Road C, subject to the following <br />conditions: <br />
