FINAL CITY of ROSEVILLE PLANNED UNIT DEVELOPMENT AGREEMENT # This AGREEMENT, dated February 12,200 l, is entered into between the City of Roseville, a NTinnesota municipal corporation (herein referred to as "CTTY"), and McKinley Companies, Inc., 300 South Owasso Boulevard East, Saint Paul, Minnesota 55 117(hereln after referred to as "DEVELOPER"). 1.0 EFFECTIVE DATE of AGREEMENT This agreement sha11 be effective upon completion of the following: A. Comprehensive Land Use Plan Amendment. B. Passage and publication of Ordinance # Rezoning of Property to B-PUD). C. Publication of the ordinance in the Roseville Review, the CITY's official newspaper D. Execution of this agreement by the CTTY and the DEUELOPER. E. Recording of this agreement with Ramsey County. 2.0 REQUEST for PUD APPROVAL The DEVELOPER has requested the CTTY approve a Planned Unit Development (PUD) (PF#3277) that redevelops the former .56 acre residential parcel (two homes used to occupy the parcel) into a five unit (attached) office condominium site. The properiy is described as follows: 2330 Le�ngton Avenue North (PID 1129233320050) City of Roseville, Minnesota, legally described as follows: Lot 4, Block 1, Rose Sharon 2°d Addition, City of Roseville, Ramsey County, Minnesota. 3.0 PUD APPROVAL The CITY hereby grants approval of the final development plan for McKinley Companies, subject to the DEVELOPER's compliance with the terms and conditions of this agreement. The CITY agrees to approve applications for building permits, provided that said plans are consistent with the e�ibits listed in Section 4 below. For any improvements proposed thereafter, notwithstanding anything in this Agreement to the contrary, the CITY may require compliance with any amendments to the City's Comprehensive Guide Plan, ofiicial controls, platting or dedication requirements enacted after the date of this Contract.
