forth. Such work as described immediately above sha11 constitute "Engineering and Inspection" <br />and shall be so referred to hereinafter. <br />2. The contract cost of the work or, if the work is not contracted, the cost of all labor, <br />materials and equipment rental required to complete the work, except the cost of providing the <br />power supply to the service pole or pad shall constitute the actual "Construction Cost" and shall be <br />so referred to herein. <br />3. The County sha11 revise or cause the revision of said traffic control signals with street <br />lights, signs, interconnect and EVP system in accordance with the plan and specification for S.A.P <br />No. 62-625-22 on County Road B at Victoria Street. County and City will participate in <br />construction costs as follows: 75% County and 25% City. Estimated cost for the signal revisions <br />is $156,992.00. <br />4. City sha11 be responsible for the continuation of an adequate electric power supply to the <br />service pad including any necessary e�tensions of power lines. Upon completion of the revision of <br />the traffic control signals with street lights and EVP system City sha11 be responsible to pay <br />electrical costs for the traffic signal and street lights. <br />5. Upon completion of the traffic control signals, County sha11 maintain and keep in repair <br />the traffic control signal including relamping cleaning and painting at its cost and expense. <br />6. Upon completion of the work along County Road B from Pascal Street to Dale Street it <br />shall be the County's responsibility, at its cost and expense to maintain and keep in repair the <br />interconnect. <br />7. Upon execution of this agreement and a request in writing by the County, City shall <br />advance to County an amount equal to their portion of the project costs based on the actual bid <br />price plus six percent (6%) of such amount for the each share of the cost for engineering and <br />inspection. <br />8. Upon final payment to the contractor and computation of City share for the work provided <br />for herein, any amount of funds advanced in excess by City final share will be returned without <br />interest. City agrees to pay to the County that amount of its final share which is in excess of the <br />amount of the funds advanced by City. <br />9. The EVP Systems "D" shall be operated, maintained, revised or removed in accordance <br />with the following conditions and requirements: <br />a) All modifications, revisions and maintenance of the EVP System considered necessary <br />or desirable for any reason, shall be done by County forces, or, upon concurrence in <br />writing by the County's Traffic Engineer, may be done by others all at the cost and <br />expense of the City. <br />b) Emitter units may be installed and used only on vehicles responding to an emergency as <br />defined in Minnesota Statutes Chapter 169.01, Subdivision 5 with 169.03. <br />PW2001-04 <br />2 <br />
