Mn/DOT Agreement No. 81361 CFMS Contract No. A-20885 STATE OF MINNESOTA JOINT POWERS AGREEMENT FOR PROFESSIONAL/TECHNICAL SERVICES This agreement is between the State of Minnesota, acting through its Commissioner of Transportation ("State") and the City of Roseville through its City Council, address 2660 Civic Center Drive, Roseville, MN 55113-1815 ("City"). Recitals 1. Under Minn. Stat. §§ 15.061 and 471.59 the State is empowered to engage such assistance as deemed necessary. 2. The State is in need of a drainage modeling study on a segment of Trunk Highway (T.H.) 36 in Roseville. 3. The City represents that it is duly qualified and agrees to perform all services described in this agreement to the satisfaction of the State. 4. Exhibit A is attached and incorporated herein by reference. Agreement Introduction: The City has requested that a second storm drainage culvert be jacked under T.H. 36 to alleviate flooding on the south side of T.H. 36. The Minnesota Department of Children, Families and Learning is the occupant of the flooded building. A solution to the flooding needs to be developed because flooding has occurred twice in the two years this agency has occupied the building. The State's Metro Division Water Resources Engineering office is requiring that the drainage to the culvert be modeled using XP-SWMM, a computer program which will give more accurate results than the study the City had already done using HydroCad and from previous studies done in the 1970's. State's Metro Division Waters Edge building is the downstream recipient of the drainage coming through the T.H. 36 culvert to Zimmerman Lake. The basement level of the Waters Edge building is lower than the 100 year flood level of Zimmerman Lake, according to two flood studies done in the 1970's and the City's' 1990 Surface Water Management Plan. An accurate study is needed to determine if the Waters Edge building will be in greater danger of flooding if the City jacks a second culvert under T.H. 36. 1 Term of Agreement 1.1 Effective date: May 1, 2001, or the date the State obtains all required signatures under Minnesota Statutes Section 16C.05, subdivision 2, whichever is later. 1.2 Expiration date: December 31, 2001, or until ail obligations have been satisfactorily fulfilled, whichever occurs first. 2 Agreement between the Parties The City will: 1.
