Mn/DOT Agreement No. 81361 <br />CFMS Contract No. A-20885 <br />STATE OF MINNESOTA <br />JOINT POWERS AGREEMENT <br />FOR PROFESSIONAL/TECHNICAL SERVICES <br />This agreement is between the State of Minnesota, acting through its Commissioner of Transportation <br />("State") and the City of Roseville through its City Council, address 2660 Civic Center Drive, <br />Roseville, MN 55113-1815 ("City"). <br />Recitals <br />1. Under Minn. Stat. §§ 15.061 and 471.59 the State is empowered to engage such assistance as <br />deemed necessary. <br />2. The State is in need of a drainage modeling study on a segment of Trunk Highway (T.H.) 36 in <br />Roseville. <br />3. The City represents that it is duly qualified and agrees to perform all services described in this <br />agreement to the satisfaction of the State. <br />4. Exhibit A is attached and incorporated herein by reference. <br />Agreement <br />Introduction: The City has requested that a second storm drainage culvert be jacked under T.H. <br />36 to alleviate flooding on the south side of T.H. 36. The Minnesota Department of <br />Children, Families and Learning is the occupant of the flooded building. A solution <br />to the flooding needs to be developed because flooding has occurred twice in the two <br />years this agency has occupied the building. The State's Metro Division Water <br />Resources Engineering office is requiring that the drainage to the culvert be <br />modeled using XP-SWMM, a computer program which will give more accurate <br />results than the study the City had already done using HydroCad and from <br />previous studies done in the 1970's. State's Metro Division Waters Edge building is <br />the downstream recipient of the drainage coming through the T.H. 36 culvert to <br />Zimmerman Lake. The basement level of the Waters Edge building is lower than <br />the 100 year flood level of Zimmerman Lake, according to two flood studies done in <br />the 1970's and the City's' 1990 Surface Water Management Plan. An accurate study <br />is needed to determine if the Waters Edge building will be in greater danger of <br />flooding if the City jacks a second culvert under T.H. 36. <br />1 Term of Agreement <br />1.1 Effective date: May 1, 2001, or the date the State obtains all required signatures under <br />Minnesota Statutes Section 16C.05, subdivision 2, whichever is later. <br />1.2 Expiration date: December 31, 2001, or until ail obligations have been satisfactorily fulfilled, <br />whichever occurs first. <br />2 Agreement between the Parties <br />The City will: <br />1.
