2.4 Upon completion of its 1997 Comprehensive Land Use Plan, the city had compiled a list
of properties whereby the zoning and Comp Plan designations did not match. In the case
of the subject parcel, located in Planning District 12, the Comprehensive Land Use Plan
designation is I'igh Density Residential. The esting land use (designated single family
attached) map is a remnant of years past when the owner lived in and rented units within
the structure. Today we would identify this as "multi family."
3.0
3.1
3.2
PROJECT REVIEW
Mr. Prokop has indicated an interest in completing interior remodeling and constructing a
detached garage, but does not intend to change the use of the five-unit structure.
The following R-3A District requirements would apply to the site:
Kequirements
Lot Width
Lot Depth
Lot Size Per Unit
Front Yard Setback
Rear Yard Setback
Side Yard Setback (south
City Code
85 feet
100 feet
2,000 — 2,800 sq. ft./unit
Three stories or 30 feet
30 feet
30 feet
15 feet
Condition
110 feet
148 feet
16,28o sq. ft./3,256
Two stories
30 feet
52 feet
7 feet
ft
Variance
None
None
unit None
None
None
None
9 feet
Side Yard Setback (north) 15 feet 35 feet None
4.0 STAFF COMIVNTS/FINDINGS
4.1 Staff has determined that rezoning the properiy to a zoning designation consistent with
the Comprehensive Land Use Plan is necessary to appropriately deal with the pre-
esting non-conforming use issue.
4.2 Through review of the Zoning Ordinance, staff has determined that the zoning
designation that best suits the properiy and its current use as a multiple family residential
structure (five rental units) is the R-3A zone.
4.3 Because of the change in zoning from R-2 to R-3A, staff has concluded that a nine-foot
variance to the side yard setback (esting condition) for the south side of the principal
structure is necessary.
4.4 A non-conforming use can continued but is subject to applicable State Statutes and City
Ordinance regarding alterations, repair after damage, discontinuance of use, and
intensification of use.
PF3305 .- RCA 06 110 1.doc Page 2 of 4
