9. Propertv Access. <br />(a) Lessee, at a11 times during this Lease, shall ha�e vehicle ingress and egress <br />over the Properry by means of the e�sting access twenty four (24) hours per day and seven (7) <br />days per week, subject to notice requirements to Owner as set forth in Section (b) below. <br />(b) Lessee, at a11 times during this Lease, shall have access to the Properiy in <br />order to install, operate, and maintain its Antenna Facilities. Lessee or its employees, agents, or <br />subcontractors will be required to sign-in before entering onto the property, except in an <br />emergency situation. Owner will be responsible for determining the sign-in location. <br />(c) Lessee is also granted the right, at its sole cost and expense, to enter upon <br />the Owner's property prior to the Commencement Date to determine the Leased Property's <br />suitability for any intended use of Lessee, which studies may include surveys, environmental <br />evaluations, radio wave propagation measurements, field strength tests and such other studies as <br />Lessee deems necessary or desirable. <br />10. Utilities. Owner represents that utilities adequate for Lessee's use of the Properiy <br />are a�ailable. Lessee will cause its utilities to be separately metered. Lessee will pay for all <br />utilities used by it at the Properiy. Owner will cooperate with Lessee in Lessee's efforts to <br />obtain utilities and separate metering of same from any location provided by Owner or the <br />servicing utility. <br />11. Personal Properiv and Real Estate Taxes. If any such improvements constructed <br />on the Property should cause part of the Property to be taxed for real estate purposes, it shall be <br />the liability of said Lessee to pay such property taxes that are attributable to the Lessee's <br />equipment on the properiy, within thiriy (30) days of receiving the tax bill. <br />12. Compliance with Statutes, Re�,ulations, and Approvals. Lessee's use of the <br />Properiy herein is contingent upon its obtaining a11 certificates, permits, zoning and other <br />approvals that may be required by any federal, state or local authority (Engineering study, radio <br />frequency interference study, etc.). Lessee's Antenna Facilities and any other facilities shall be <br />erected, maintained and operated in accordance with site standards, state statutes, rules and <br />regulations now in effect or that thereafter may be issued by the FCC and related governing <br />bodies. <br />13 . Interference. <br />(a) Lessee's installation, operation, and maintenance of its transmission <br />facilities sha11 not interfere in any way with Owner's Fire Department or other City operations. <br />Any such interference shall a11ow Owner to terminate this Lease as provided in Paragraph 13. <br />(b) Lessee sha11 not use the Site in any way that interferes with the e�sting <br />use by (i) Owner or (ii) Lessees or licensees of Owner holding rights to the Owner's Properiy on <br />the Effective Date ("E�sting Lessees"). <br />83831 4 <br />
