66/26/2001 19:10 16515780701 NIEMI LAW OFFICE, PA PAGE 02
Page # 2
This morning, it came to my attention that I had not been provided the same information that
has been provided to the commission members. This prevented the Mayor and i from being
fully prepared for the meeting. Specifically, a letter fmm the complainant, date June 22,200 I
was circulated among commission members, when they made ICFCrCGC to it, I had to request a
copy from the chairperson. This is unacceptable. This letter should have been delivered to my
office either by mail or fax prior to the meeting.
It is my recommendation to the City Manager, that the full ethics commission meet to add ress
these procedural problems and the conflict of interest issues before proceeding to address the
complaint against the Mayor.
It is unfortunate that now, Council Member Dean Maschka, former City Manager Steve
Sarkozy, Acting City Manager Ed Burrell, and City Attorney Joel .rtttik, have all been
dragged into this action by the June 22,200 1 correspondence from Mr. Lambert.
In order to address these issues, the Mayor deserves the right to confront his accusers. False
claims of receiving information from the city attorney, claims based upon overheard
conversations, and information found on peoples doorsteps in brown paper bags, axe difficult if
not impossible to address. Until the real and true complainant steps forward, these issues
cannot be addressed fairly.
The Ethics Commission needs to demand that the real complainant step forward before
thousands of taxpayer dollars are spent on the investigation of a complaint that is based upon
accusations found in a brown paper bag placed on the door step of the complainant. This
according to the complainant Mr. Lambert.
I believe their are good volunteers on the Ethics Commission who vt to do ther job,
however, until these issues are resolved the Mayor cannot receive a fair hearing.
Sincerely,
Keith A. Niemi
Attorney at Law
Cc: Mayor John Kysylyczyn
