1.0 <br />� <br />REQUEST FOR CITY COUNCIL ACTION <br />D A T E: 09/24/O1 <br />ITEM NO: c-4 <br />rt,me�nt�ripproval: I�i;��rlp roved: r'lgenda Secaon: <br />;� f �,� CONSENT <br />Description: f� request b}� Darlene Frickson & Scott Nelson for a Minor Subdivision <br />(Correction) to mociiFy the e.tisting property line between 2185 and 2175 North <br />Oxford Street (PF3344). <br />REQUESTED ACTION <br />Ms. Darlene Erickson and Mr. Scott Nelson, properry owners at 2 185 and 2 175 North <br />O�ord Street respectively, have requested the City Council approval of a"Correction" <br />between two legal conforming lots in Roseville. <br />1.2 Section 1104.04D specifies the procedures for consideration and approval of a <br />"Correction." Specifically, this section of the City Code states: "Corrections: When a <br />survey otdescription of a parcel or lot has been found to be inadequate to describe the <br />actual boundaries, approval of a corrective subdivision may be requested. This type of <br />subdivision creates no new lots or streets. The proposed corrective subdivision, in sketch <br />plan form, along with a letter signed by a11 affected owners agreeing to the new <br />subdivision, sha11 be submitted to the City Council for approval. No hearing or Planning <br />Commission review is necessary unless the proposal is referred to the Commission by the <br />Community Development Director for clarification. The proposed parcels sha11 not cause <br />any portion of the e�sting lots, parcels, or e�sting buildings to be in violation of this <br />regulation or the zoning code. A certificate of survey illustrating the corrected <br />boundaries sha11 be required on all parcels. Within thirty (30) days after approval by the <br />City Council, the applicant sha11 supply the final survey to the Community Development <br />Director and City Manager for review and approval. After completion of the review and <br />approval by the Community Development Director and City Manager, the survey shall be <br />recorded by the applicant with the Ramsey County Recorder within si�ty (60) days. <br />Failure to record the subdivision within si�iy (60) days sha11 nullify the approval of the <br />subdivision. <br />2.0 BACKGROUND <br />2.1 Ms. Erickson owns the property at 2 185 North O�ord Street and desires to split off a <br />sma11 portion of the side yard (south). The proposal would create a triangular piece of <br />land 8 feet wide at the street right-of-way and 194 feet deep and totaling 1,067 square <br />feet (see attached). <br />2.2 A privacy fence was erected a number of years ago near the south property line of 1285 <br />North �ford Street. This fence separated the two properties and left the odd shaped lot <br />remnant, which has been cared for by NIr. Nelson. <br />Page I of 2 <br />
