(Reserved for Recording Data) <br />ASSESSMENT AGREEMENT <br />THIS AGREEMENT (the "Agreement") made this day of , <br />200 1, by and between the CITY OF ROSEVII,LE, a Minnesota municipal corporation <br />("City" ��� offices at 2660 Civic Center Drive, Roseville, NTinnesota 55 113, and <br />Wellington Management Inc., a Minnesota corporation, with offices at 1625 Energy Park <br />Drive ("Owner"). <br />Recitals: <br />WHEREAS, Owner owns the property described in E�ibit "A", with a street <br />address of 1300 Commerce Street, Roseville, Minnesota 55 113, and parcel identification <br />number of 1 0-29-23-34-0002; and <br />WHEREAS, the City and Owner desire to construct and maintain certain <br />stormwater improvements ("Improvements") more fully described in that Feasibility <br />Report titled Zimmerman Lake Drainage Improvements, dated July 23, 2001, prepared by <br />WSB and Associates, and; <br />WHEREAS, the Owner hereby agrees to have its allocated share of the costs of <br />the Improvements levied as special assessments against such properiy in the manner <br />hereinafter provided; and <br />WHEREAS, the City is willing to construct and maintain the Improvements in <br />consideration of the Owner' paying such special assessments; and <br />WHEREAS, Owners are willing to waive any and a11 substantive objections to <br />such special assessments and to the absence of any prior hearing or other procedural <br />requirement preliminaty to the levying of such assessments; and <br />
