Determination bv City's Inspection Staff that the tree marked is "Hazard to persons <br />or property on abutting property (§706.07D and I�": <br />§706.07D- As illustrated in the photograph supplied by you (the lower left <br />photograph in which a City employee is seen standing next to the neighbor's <br />storage shed or the property where the neighbor seems to fear that the tree may <br />fa11), the tree branch has already been pruned with a clean cut of the respective <br />area (see photo). <br />There does not seem to be adequate justification for further pruning under this <br />section of the City Code. <br />§706.07F- As illustrated in the photograph supplied by you (the upper left <br />photograph) and the notes made by City "Trim here • Right half only", the City <br />seems to be interested only in protecting the personal interests and safety of one <br />individual (my neighboring resident at 653 Lovell Ave) and not concerned if there <br />is any safety hazard (falling on powerline) in the public interest of all taxpaying <br />City residents in the area including me and the said neighbor. How does the City <br />inspection staff conclude that only one half of the tree is a danger and it is likely <br />to fa11 only on my neighbor's property? <br />There is no adequate demonstration or elaboration by the City that the tree <br />constitutes a health or safety hazard to the public (not one individual only and <br />ignoring others) and therefore application of this section of the City Code does <br />not seem justified unless the basis for the dangerous tree declaration is revealed in <br />detail. <br />
