Remedial action:
The tree under question is adj acent to powerlines and if it were to fall it is likely
to first hit the powerline before falling on my property or neighbor's property. If
the City's Horticulturist's opinion that the tree is likely to fall, the City should
really consider the impact of fall on the powerline which is in the public interest
of a11 residents in the area including me and the neighbor at 653 Lovell Avenue.
The tree's fa11 on the powerline has potential for adverse impacts with disruption
of power supply for several City residents in the neighboring area in addition to
the safety/ risks for persons or real estate in the vicinity of its location.
If the tree's inspection staff is of the opinion that the tree will not fall on the
powerline but only on the neighbor's properiy or does not think the tree's fa11 on
powerline is a concern for the City, please let me know so in writing. In that
case, I would like to bring it to the attention of the State Commissioner of
Agriculture for proper remedial action including investigation for decertifying or
re-certifying the inspection process followed by the City or its appointed officials
and also bring it to the knowledge of other residents of City of Roseville through
appropriate media resources so that City's taxpayers will become aware of the
fairness, competence or otherwise of the inspection process followed by the City
using their tax dollars. I will also consider the other options available to me
including legal remedy for fair and just treatment to me from the City.
I request via this appeal that the City of Roseville act in the public interest of all
City residents living in the area and arrange for notification to me or the power
utility company (Excel Energy) that this tree is a hazard to the powerline and
residents in the vicinity and allow sufficient notice of time for its removal (if the
City's Tree Inspection Staff is convinced based on facts that the tree is dangerous
or is about to fall).
