Rule 9- No comments or suggeations. <br />Rule 10- Regarding first/second reading of ordinance, current Rule 11 <br />allows a waiver of the 2 week delay "by unanimous vote by the council." <br />Given the possible need for emergency ordinances, I recommend retention of <br />similar language in the revised rules. <br />Rule 11- No comments or suggestions. <br />Rule 12- Mayor appointment section specifies "Council subcommittees or task <br />forces." A dispute could arise whether this delegation of authority is <br />intended to extend to commissions established by ordinance or bodies <br />established pursuant to state law. In order to clarify the extent of the <br />authority to be delegated, 2 suggest that language similar to ^except as <br />specified by law or ordinance" be added to the delegation of authority. <br />Further, the additional sentence which provides that "selections may be <br />reviewed by the full Council within 30 days of appointment" should be <br />reexamined to determine whether the intent is to require council consent if <br />there is an appeal of the appointment, mandatory consent, or simply a review <br />and comment opportunity. <br />Rule 13- "Al10Cat10II" of office space remains a concern in that regardless <br />of how one chooses to define allocation (designating and assigning a space <br />to use v. scheduling existing space) there will be uncertainty regarding <br />what authority has been delegated, whether that authority is fundamentally <br />that of the Council or Manager, and whether the exercise of that authority <br />conforms to the delegation by the Council. It would seem possible to avoid <br />all of these legal and implementation questions by having the Mayor and <br />Council clearly communicate what they want to have for office space to the <br />Manager. <br />Rule 14- There is no legal restriction on designating anyone as the <br />^official spokesperson". but there is substantial 1ega1 uncertainty regarding <br />the meaning of the designation as well as the implicit disqualification of <br />other officials and staff designated by law, ordinance, or council action to • <br />speak on behalf of the city. <br />Rule 15- No comments or suggestions. <br />Rule 16- No comments or suggestions. <br />Rule 17- No comments or suggestions. <br />
