Date: Ol/28/02 <br />Item: VI D <br />City Manager's Proposed "Employee-Council" <br />Communication Policy, with attachments <br />The Council has asked me to draft a proposed Employee-Council <br />Communication Policy. <br />By way of background, here is the Council Rule that Council Member <br />Schroeder proposed on this subject: <br />"The City Manager or any employee under his direction shall <br />not prevent another employee from communicating with any <br />elected official. The City Manager shall be responsible for <br />enforcing this rule and shall establish written disciplinary <br />measures. All violations shall be immediately reported to the City <br />Council." <br />Among other comments, I pointed out that there are certain <br />circumstances where employees or other persons are required not to <br />speak to anyone about a subject. Examples include criminal <br />investigations and certain civil investigations, such as those involving <br />allegations of sexual harassment. <br />If the Council is concerned about this issue, I suggest something like the <br />following language: <br />"Except as provided otherwise by law, the City Manager shall <br />provide the City Council with all information they request about <br />City business. Council Members may also communicate with and <br />secure information from any City Employee about City business <br />that any resident of Roseville may request and obtain. The City <br />Manager and all City Employees shall make the same information <br />available to all Council Members, and the information is subject to <br />public disclosure under the Minnesota Data Practices Act. <br />Pursuant to State Law, Council Members shall not give orders or <br />direction to City Staff except orders or direction given to the City <br />Manager by a majority of the City Council. <br />Pursuant to State Law, the supervision of City Employees is <br />the responsibility of the City Manager. Any City Employee who <br />wishes to have a workplace grievance or service-related issue <br />addressed may talk to their supervisor, department head, and the <br />City Manager at any reasonable time." <br />Attached for the Council's information are flow charts outlining the <br />grievance or complaint process we follow for both union and ri0ri- <br />unionized employees. <br />Respectfully submitted, <br />Neal Beets <br />
