4.0 <br />5.0 <br />contrary, the CITY may require compliance with any amendments to the its Comprehensive <br />Guide Plan, official controls, platting or dedication requirements enacted after the date of this <br />Agreement. <br />APPROVAL by the CITY <br />The CITY hereby approves the following plans on file with the City. The DEVELOPER shall <br />develop the subject property in accordance with these plans. If, however, the plans vary from <br />the written terms of this Agreement, the written terms shall controL If the plans address items <br />not specifically addressed in this Agreement, the plans shall govern with respect to those items. <br />The plans are: <br />Exhibit A Certificate of Survey and/or approved plat of the existing property including all <br />land features, dated <br />Exhibit B Site development plan that includes property boundary, building setbacks, <br />structure location (including the trash enclosure), curbing, and parking setbacks <br />(each individual development project), dated <br />Exhibit C Grading plan illustrating existing grades and those proposed after completion <br />of the proposed construction, drainage directions, spot elevations, catch basins <br />for surface water catchment; utility plan indicating sanitary sewer, watermain, <br />gas, electric, and storm sewer connection; and the erosion control plan, dated <br />Exhibit D <br />Exhibit E <br />Exhibit F <br />Exhibit G <br />Exhibit H <br />Exhibit I <br />Exhibit J <br />Site lighting plan including specifications and lighting calculations for parking <br />lot, dated <br />Landscape plan including materials list, sizes, and locations of all plant <br />materials, dated <br />Building floor plans of each complex with dimensions of the facility, dated <br />Building elevations of each complex, with dimensions and materials identified, <br />dated <br />Professional office condominium by-laws, dated <br />Perpetual joint access, drive, and parking easement, dated <br />Site maintenance agreement and/or association, dated <br />Exhibit K Anticipated site development schedule with estimated date of construction <br />start, construction completion, utility, curb, gutter and landscape installation, <br />and tentative occupancy date, dated <br />REZONING <br />2 <br />
