�� �� <br />CITY of ROSEVILLE �� � � �� <br />PLANNED UNIT DEVELOPMENT AGREEMENT <br />This PLANNED UNIT DEVELOPMENT AGREEMENT, dated February 12,200 1, is entered into <br />between the City of Roseville, a NTinnesota municipal corporation, of 2660 Civic Center Drive, <br />Roseville, NTinnesota 55 113 ("CITY"), Accessible Space, Incorporated, 2550 University Avenue, Suite <br />330 North, Saint Paul, MN 55 114 ("DEVELOPER"), and VSI Construction, Incorporated, 1175 1 Troy <br />Lane North, Maple Grove, Minnesota 55369 ("DEVELOPER"). <br />1.0 EFFECTIVE DATE of AGREEMENT <br />This agreement sha11 be effective upon completion of the following: <br />1.1 Comprehensive Land Use Plan Amendment of property from Low Density Residential <br />(LR) and Business (B) to High Density Residential (HIZ) and Business (B). <br />1.2 Passage and recording of Accessible Space Addition (subdivision plat of property for <br />proj ect). <br />1.3 Passage and publication of Ordin (rezoning of properiy to PUD). <br />1.4 Publication of the ordinance in ville Review, the CITY's official newspaper <br />1. S Execution of this agreement by nd the DEVELOPER. <br />1.6 Recording of this agreement wit��ICounty. <br />2.0 REQUEST for PUD APPROVAL <br />The DEVELOPER has requested that t pr�ove a Planned Unit Development (PUD) <br />(PF# 3224) that redevelops four busines rcels (Aces Phillips 66 gas station & <br />Champion Upholstery) into a two story �quare foot professional office complex <br />and a three story 22 unit (s q . supp ive housing complex for the physically <br />handicapped. The subject properties ad ess i 12 Lexington Avenue. The subject <br />parcels are legally described as Lot 1 a , ccessible Space Addition, Ramsey <br />County, Minnesota. The subject property's tax'identification numbers are 142923320060, <br />142923320061,142923320062, and 142923320063 respectively. <br />3.0 PUD APPROVAL <br />The CTTY hereby grants approval of the Planned Unit Development (identified as E�ibit � <br />in Section 4 of this Agreement), subject to the DEVELOPER's compliance with the terms <br />and conditions of this Agreement. The City agrees to approve applications for building <br />permits, if said applications are consistent with the plans identified in Section 4.0 below. <br />For any improvements proposed thereafter, notwithstanding anything in this Agreement to the <br />
