CITY OF LAUDERDALE <br />ASSESSMENT POLICY MANUAL <br />SECTION 9: LOCAL IMPROVEMENT PROCESS <br />A. INITIATION OF PROCEEDINGS <br />Improvement project proceedings may be initiated in any one of the three (3) following <br />ways: <br />. Petition by not less than thirty five percent (35%) of the affected property owners <br />determined by front footage. <br />. Petition by 100% of the affected property owners. <br />. By order of the City Council. <br />B. PROCEDURAL STEPS FOR PROJECTS WHICH ARE NOT 100% <br />PETITIONED <br />An improvement project that is initiated by action of the City Council or by a 35% <br />petition may be ordered only after a public hearing. The following are the procedural <br />steps that must be followed by the City Council prior to the ordering of an improvement <br />if it is not initiated by a 100% petition. <br />Feasibility Report. Prior to adopting a resolution calling a public hearing <br />on an improvement, the City Council must secure from the City Engineer a <br />report advising it in a preliminary way: <br />a.) as to whether the proposed improvement is feasible; <br />b.) as to whether it should be made as proposed or in connection with <br />some other improvement; and <br />c.) the estimated cost of the improvement. <br />[See "Resolution Ordering a Preparation of Report on the Improvement" <br />attached in the Appendix as Form 4A] <br />Resolution Calling Public Hearing. The City Council must adopt a <br />resolution calling a public hearing on the improvement project. Mailed and <br />published notice of the hearing must be given as described in the next <br />paragraph below. The notice of public hearing must include the following <br />information: <br />a.) the time and place of the public hearing; <br />b.) the general nature of the improvements; <br />c.) the estimated costs; and <br />d.) the area proposed to be assessed <br />14 <br />
