Resolution Determining Sufficiency of Petition and Ordering Improvement. <br />Upon receipt of the 100% petition, the City Council must determine that it <br />has been signed by 100% of the owners of the affected property, and that <br />they have agreed to pay 100% of the costs of the improvements. After <br />making this determination, the project may be ordered without a public <br />hearing. <br />D. ISSUANCE OF BONDS <br />At any time after the City Council has ordered the improvements, the City Council may <br />issue its general obligation bonds to finance the cost of the improvements. In the event <br />of any omission, error or mistake in any of the proceedings precedent to the ordering of <br />the improvements, state law provides that the validity of the bonds will not be affected <br />by such deficiencies. However, deficiencies in these proceedings may result in property <br />owners successfully appealing the special assessments levied against their property. <br />The resolution authorizing the issuance of the bonds will contain covenants by the City <br />Council that at least 20% of the cost of each improvement project will be specially <br />assessed against the benefited property, and the City Council will take all further actions <br />and proceedings necessary in order for the final and valid levy of special assessments. <br />These two covenants are necessary in order for the bonds to be issued without an <br />election. <br />E. LETTING CONTRACTS <br />Ordering Plans and Specifications. After the ordering of an improvement <br />project, the City Council must order the preparation of plans and <br />specifications.
