Hearing Process <br />lmprovement Hearing: After a petition is filed and its adequacy <br />determined, or the Council initiates the proj ect, the City Engineer <br />is directed to study and report as to the feasibility of the intproveme;it. if <br />after reviewing the feasibility report, the Council feels the project is <br />feasible, a public improvement hearing is scheduled, notice published, and <br />persons benefited by the project notified in writing in accordance with <br />applicable State Statutes. (At its discretion, the City Council may choose <br />to hold the assessment hearing simultaneous with the improvement <br />hearing.) <br />I� after' the innprovement hearing, at which a11 persons are head, the <br />Council feels that the proj ect is feasible, then the Council may authorize <br />the preparation of necessary plans and specifications. Upon receipt and <br />acceptance o�those plans, tlte Council will authorize the advej�ise�xiont for <br />bids for the construction of the project. Following award of a contract, <br />construction of the improvement will commence. <br />C. Basis of Assessment <br />Streets — General <br />.� �, <br />1. I�'r�rt���,asia,ssessments will be against the b�ne.it��ng <br />property on a front foot basis subject to modifications necessary to provide <br />for a minimum and maximum assessment for residential lots. <br />F�esiate,Qtial �rr ('aomrmencial �'o�tn�l2es. s s m e n t form:slas w i 1 <br />be used, one for residential property (hereinafter referred to as "residential <br />rate" or "residential property" and the second rate for commercial, <br />industrial, school, church, nursing home property and other public?y <br />owned property (hereinafter referred to as"commercial rate" or <br />"commercial property"). <br />Sin�,,te Fronta�e ��tan improvement takes place along a street <br />with entirely single frontage on one side, the City will only assess 50% of <br />the project costs, subject to the appropriate formulas. The other 50°'0 of <br />the project costs attributable to the side of the street without developable <br />frontage sha11 be borne by the City. In the event the application of this <br />formula results in an asscssment that is lower than the "norm" bastd on <br />comparisons with other improvements, the City reserves the right to adjust <br />the assessment in order to create a more equitable situation. <br />Per Lot Assessment. The City reserves the right at its sole discretion to <br />utilize a"per lot" assessment melhodology when it appears to result in <br />
