The design of the transit shelters shall he submitted to <br />and ��ppr��ved by the City prior tc� construction. <br />Outdoor Promotions may subcontract for project management, site preparation, <br />installation and maintenance of the transit shelters. The names of such subcontractors <br />sha11 be provided to the City upon request. Outdoor Promotions sha11 also l�a�•r� the <br />right of first refusal to install and maintain additional transit shelters within tl���� Cit�� <br />beyond those provided in the current Transit Shelter Program. <br />2, Maintenance. The transit shelters shall be maintained a minimum of tt��icr� <br />weekly with such maintenance to include sweeping, cleaning, emptying trash <br />receptacles, picking-up litter/debris about the shelter, and removing gr��t�fiti. �ht�ltt�rs <br />and sidewalks shall be power-washed at least once each month, weather permittiiz;;. <br />3. Repair and Replacement. Outdoor Promotions shall at its own cost and ��� i t h i n <br />foriy-eight (48) hours of receipt of notification thereof from the City, repair or repl���:t� <br />any dama�;ed or defaced shelters or individual parts thereof. <br />4. Advertising. Each transit shelter installed by Outdoor Promotions sha11 i-��nt��in <br />two panels for advertisin�; displays measuring no more than 4fi" wide and 7?" higl�, <br />either positioned to form a triangle or placed back-to-back on one-wav streets. Where <br />the sidewalk is detached 1»�j is situated behind the shelter, a third panel will be a�ldt�d <br />on the back of the triangle for the City's use for public service announcements. Such <br />displays sha11 be used solely for advertising materials and/or public ser�:ice <br />announcements. Outdoor Promotions shall use its best reasonable efforts to obtain <br />revenue generating advertisements for the two (2) advertising display panels tlz�t faiE <br />the street on each transit shelter, except where the City has tlle ri�;ht to utilize a����»t�i t��r <br />public service announcements. <br />Except with respect to the monthly fee payable to the City pursuant to Article IV l tt� rt�� � t, <br />Outdoor Promotions shall ha�e the right to retain a11 re�r�nLies r�cner� ted from t llr� <br />advertising displays on all transit shelters. Under no circumstances shall an�� <br />advertising display contain indecent or vulgar pictures, graphics or language o1- include <br />advertising for any alcohol or tobacco products. Outdoor Promotions further a;;r�tti not <br />to display advertising relating to contraception, _ pornography, politics or reli�;1011. <br />Outdoor Promotions �a�;rees to remove within fortv-eight (�S) hours after its receipt �,f <br />the City's written notification requesting such removal, anv advertisements ���hich the <br />City in its reasonable discretion deems to be offensive, or in contlict ���ith the Cit��'� <br />health, safety and welfare concerns. In the e��ent that Otitdoor Promotions fails t�� <br />remo�-e such advertisements within such foriy-eight (4�)-hour period, the Ci t�� m ��� <br />remove the materials at Outdoor Promotions' sole cost and expense. <br />
