REQUEST FOR CITY COUNCIL ACTION
DATE: 06/lp/02
ITEM NO: III. A.
Departme t Ap roval: Mana r proved: Agenda Section:
HEARINGS
tem eSCription: Hearing for Property Abatement: 2154 Lexington Avenue,
(vacant Jiffy Gas Station)
1.0 BACKGROUND
1.1 Periodically the Community Development staff reviews Code violations relating to property
maintenance to determine whether there are properties in disrepair for extended periods. The
staff spends time attempting to gain voluntary compliance during the year on these properties.
Generally, they have not met the Code because the owner has been absent, unable (physically or
financially), or unwilling to comply with the Code. Property abatement is one remedy. It
allows the City to order corrections and assess the property for the work. This process has
been used in previous years to secure buildings from vandals and weather, clean up buildings,
paint and/or restore siding, plug rodent holes, repair windows and fi failing garage roofs and
doors.
1.2 The staff attempts to work with property owners to bring the structure into compliance (and
continues to encourage property owners to repair properties up to the time of a Council hearing).
The hearing is an opportunity for the property owners to address the property repair issues,
estimated costs of repair, and suggest altematives to the abatement process. The process is
attached.
1.3 The City goals within the comprehensive plan are protect and improve property values (Goals
3,4, and 5; page 6 and 7, Section 3) and to adhere to performance standards which protect the
integrity of commercial areas and neighborhoods (Policy 6, page 8, Section 3).
1.4 The conditions that prompted the abatement action (and the recent repairs completed by
the properiy owner) include:
o The gas station property is vacant and closed.
o Light panels are broken and missing
✓ On May 27th some panels were replaced; however, the
replacements were old, damaged panels from other buildings and
still constitute a nuisance violation (407.02j & K) because of their
condition.
✓
o Doors are not secured.
✓ On May 27 the doors were secured.
o Entire structure is in need of painting due to peeling paint.
o The site is littered with pallets, tires, fencing a broken cabinet and
other debris.
