The length of a shelter shall <br />be determined by the Public Works Director and shall be dependent upon the number <br />of buses or vehicles and users that frequent the bus stop. <br />F. Color: A bench or shelter shall be of a single color except a multicolored advertising <br />sign. The bench signage may be affixed to or may be used as the backrest of the <br />bench. The shelter signage may be up to two (2), four feet (4') by six feet (6') <br />advertisin��banels in a 2-sided `V' displav affixed to the end wall of the shelter (or <br />road wall on a narrow right-of-wav annlication) and nerpendicular to the roadway <br />curb or ed�e viewable from one or both ends of the shelter. The Public Works <br />Director shall determine the location of shelters to assure line of si�ht and traffic <br />safetv. Si�na�e on benches and shelters shall require permits as required bv Chanter <br />?009. <br />G. Structure Maintenance: Benches and shelters shall be equi�ed with an <br />architecturally complimentarv trash receptacle to be emptied weekly or as frequently <br />as necessarv by the vendor to comply with the City's health, safetv and welfare <br />concerns. <br />H. Liability Insurance: A certificate of liability insurance shall be filed with the City <br />covering claims for damages which might arise out of the use or placement of a bench <br />or shelter in the public right of way naming the City as an additional insured. The <br />minimum limit of liability shall be siY hundred thousand dollars ($600,000.00). <br />I. State Or County Permission: If the bench or shelter placement is in a Minnesota <br />Department of Transportation or County right of way, written permission must be <br />secured from the Minnesota Department of Transportation or the County and filed <br />with the City. (Ord. 921, 2-14-1983; 1995 Code) <br />SECTION 3. Section 1009.03 is hereby amended as follows: <br />3 9 F. Public Ways: Signs shall not be permitted within the public right of way or easements <br />4 0 except on benches and bus shelters which have received permits as per Section <br />41 703.05 , and newspaper and cabstands, all of which shall be as governed by Section <br />42 901 and Section 703.05 of this Code; and real estate signs and political signs as <br />4 3 regulated in this chapter. City, county and state traffic directional signs are permitted. <br />4 4 SECTION 4. Effective Date. This ordinance shall take effect following its passage and <br />4 5 publication. <br />46 <br />
