3.0 PUD APPROVAL <br />The CITY hereby grants approval of the Planned Unit Development (identified as <br />E�ibits A through J in Section 4 of this Agreement), subject to the DEVELOPER's <br />compliance with the terms and conditions of this Agreement. The City agrees to approve <br />applications for building permits, if said applications are consistent with the plans <br />identified in Section 4.0 below. <br />For any improvements proposed thereafter, notwithstanding anything in this Agreement <br />to the contrary, the CTTY may require compliance with any amendments to the its <br />Comprehensive Guide Plan, official controls, platting or dedication requirements enacted <br />after the date of this Agreement. <br />4.0 APPROVAL by the CITY <br />The CITY hereby approves the following plans on file with the City. The DEUELOPER <br />shall develop the subject properiy in accordance with these plans. If, however, the plans <br />vary from the written terms of this Agreement, the written terms shall control. If the <br />plans address items not specifically addressed in this Agreement, the plans shall govern <br />with respect to those items. The plans are: <br />Exhibit A Certificate of Survey/Subdivision Plat or Roselawn Village Addition <br />Exhibit B Site development plan that includes properiy boundary, building <br />setbacks, structure location (including the trash enclosure), curbing and <br />parking setbacks (each individual development project), dated May 3 1, <br />2002. <br />Exhibit C Grading plan illustrating e�sting grades and those proposed after <br />completion of the proposed construction, drainage directions, spot <br />elevations, catch basins for surface water catchment, and the erosion <br />control plan, dated May 3 1, 2002. <br />`Exhibit D Sanitary sewer and water plan illustrating a11 connections, pipe sized, line <br />locations, manhole locations, hydrant locations, and other applicable <br />utility plan information, dated May 14, 2002. <br />Exhibit E Easement plan illustrating a11 proposed easement necessary for utility <br />services, access, and parking, dated May 29, 2002. <br />Exhibit F Landscape plan including materials list, sizes, and locations of all plant <br />materials, dated May 3 1, 2002. <br />Exhibit G Site lighting plan including specifications and lighting calculations for <br />parking lot, dated May 3 l, 2002. <br />2 <br />
