EXTRACT OF MINUTES OF MEETING <br />OF THE <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br />�***���*�������** <br />Pursuant to due call and notice thereof, a special meeting of the City Council of the City <br />of Roseville, County of Ramsey, Minnesota was duly held on September 9, 2002, at 7:00 <br />p.m. <br />The following members were present: , and the following were absent: . <br />Member introduced the following resolution and moved its adoption: <br />RESOLUTION # <br />Supporting Waiver of the Attorney Client Privilege <br />WHEREAS, Mayor John Kysylyczyn, acting in his capacity as Mayor of the City of <br />Roseville, may have consulted with City Attorney Joel Jamnik as to the <br />appropriateness of Mayor Kysylyczyn voting on motion directing the City <br />of Roseville to pay his personal attorney fees, and <br />WHEREAS, Disclosing the advice given by City Attorney Joel Jamnik would be <br />helpful in determining whether Mayor Kysylyczyn acted consistent with <br />that advice, and <br />WHEREAS, It is in the interests of the City of Roseville to waive its right to assert an <br />attorney client privilege as to the advice given by City Attorney Joel <br />Jamnik to Mayor Kysylyczyn and to permit him to discuss this matter <br />with both defense and prosecution attorneys in the pending criminal matter <br />against John Kysylyczyn, <br />NOW, THEREFORE, BE IT RESOLVED, that the Roseville City Council hereby <br />1. Waives any claim it might have to assert an attorney client privilege <br />regarding any advice that City Attorney Joel Jamnik may have given <br />to Mayor John Kysylyczyn regarding his vote to pay his own attorney <br />fees, and <br />2. Permits City Attorney Joel Jamnik to discuss the advice or counsel <br />given with either prosecution or defense counsel in the pending <br />criminal matter. <br />
