that, too. Ratwik Roszak's flat fee of $8,500 covers the same legal tasks as the Campbell Knutson flat fee of
$8,500. $Oth these flat fees are comprehensive in the legal services they cover. Ratwik Roszak seems more
concerned than Campbell Knutson about how many meetings their attorneys might have to attend; RR specifically
states that their flat fee covers only 4 council meetings per month whereas Campbell Knutson has no such
restriction on the number of ineetings their flat fee covers.
"4) What happens (what would be the cost) if we exceed 4 meetings per month??"
4. I guess Ratwik Roszak would bill us hourly for that, probably at $115 per hour. If you assume our meetings last an
average of 4 to 5 hours, then the additional cost for that meeting would be $460 to $575 dollars.
"5) How many meetings are included in these flat rates??"
Campbell Knutson includes any and all meetings in their flat rate. Jensen Bell includes "all regular and special
notice meetings of the council" in their flat rate, which means meetings with individual councilmembers or citizens
are excluded and separately charged. (I don't know if JB means to exclude all meetings with staff.) Kennedy
Graven reserves the right to revise its "estimated" flat fee for such things as frequency of ineetings, so I'm not sure
we can say right now how many meetings are included in their "estimated" flat fee of $6,000. And, as noted
above, Ratwik Roszak's flat fee of $8,500 includes 4 council meetings per month.
"6) Are the meetings council meetings or any meeting??"
6. Campbell Knutson includes any and all types of ineetings in its flat fee. Jensen Bell includes only regular and
special council meetings but presumably not office hours spent with staff or other meetings with councilmembers
or citizens that would be separately billed. Ratwik Roszak includes 4 council meetings and 4 staff meetings per
month; RR would bill extra for extra meetings.
"7) What are the normal number of ineeting conducted per month??"
7. On average, there are 3 council meetings per month, there are 4 times a month when we ask the city attorney to
hold office hours so city staff or citizens or councilmembers can talk personally to the city attorney, and then there
are about 3 other times per month when we ask the city attorney to come to a special meeting that could not be
scheduled during office hours or it may involve other attorneys for other interested parties — for an average of 10
meetings per month.
Thanks for this opportunity to address your questions in advance. Let me know if you have any other questions.
But note, I have answered as to the city attorney proposals since that is what your questions seemed to touch on. The
Prosecution proposals are different in the dollar figures involved and in which law firm includes what services in their flat
fee or retainer, though the concept of the fixed fee is the same in all the proposals.
Neal
-----Original Message-----
From: Schroeder, Greg
Sent: Friday, October 11, 2002 10:28 AM
To: Beets, Neal; *RV_Council
Subject: Attorney fees
Neal
I was looking over the agenda and need help figuring out the attorney fee arrangements. Could you explain how
this works.
1) Do they (lets use CBrTlbll Knutson for example) get a flat fee say up to $8,500 and anything above that they get
$1251hoUr if a partner is used?? or do they bill on an hourly basis up to the flat monthly fee of $8,500??
2) How does this work with the other firms listed??
3) I see one firm only lists a flat fee, does that mean we get more for the $8,500 than the other firms??
4) What happens (what would be the cost) if we exceed 4 meetings per month??
5) How many meetings are included in these flat rates??
6) Are the meetings council meetings or any meeting??
7) What are the normal number of ineeting conducted per month??
Thanks!!
Please send response to my home e-mail address.
