4. The allegation is that Campbell Knutson lobbied the State <br />Le�islature without the Roseville Citv Council's Authorit,� My <br />conclusion is that Campbell Knutson attended one meeting <br />with legislators at the express direction of the then Roseville <br />City Manager to a counter lobb�ving being done bv a plaintiff <br />who had filed a lawsuit against the Citv. <br />Around 1998, before Mayor Kysylyczyn was elected or took office, the <br />Everest Group sued the City of Roseville over a tax increment financing <br />(TIF) decision the City Council had made. The City Council and the <br />League of Minnesota Insurance Trust unanimously authorized attorney <br />John Baker of the law firm of Greene Espel to represent Roseville in that <br />lawsuit. Later, when Campbell Knutson was appointed Roseville's City <br />Attorney, Campbell Knutson assisted Green Espel in the case but Green <br />Espel, and specifically Mr. Baker, remained lead counsel for Roseville <br />and did almost all of the legal work on the case. <br />On one occasion in 2000, Mr. Jamnik accompanied the Roseville City <br />Manager at that time, and other City officials, to talk to a couple of state <br />legislators about lobbying efforts of the plaintiff to change state TIF laws. <br />My findings on this allegation are that: <br />. At the express direction of the then City Manager, Mr. Jamnik <br />attended one meeting at the state capitol on this matter. He did not <br />initiate that meeting nor follow-up with other state legislators on <br />this subject. <br />That one meeting was in response to the active lobbying of the <br />plaintiff in the pending lawsuit against the City, and was <br />consistent with the unanimous direction of the City Council at that <br />time to vigorously defend the City in that lawsuit. <br />. This whole situation has been the subject of a lengthy investigation <br />by the city's former Ethic's Commission. The Ethic's Commission <br />did not substantiate any ethical violation by Mayor Kysylyczyn for <br />his part in this matter, and also summarily dismissed the ethic's <br />complaint filed against Mr. Jamnik for his very minor role in this <br />matter. <br />Conclusion <br />As the City Attorney for Mesa, Arizona for 14 years - a city larger than <br />Minneapolis, whose 20-lawyer legal staff I hired and supervised - I find <br />nothing inappropriate about Campbell Knutson's performance as City <br />4 <br />
